However, it introduces exceptions for licensed bail enforcers attempting to recover a defendant who is believed to be inside the dwelling, provided they have first-hand knowledge of the defendant's presence and that the defendant is refusing to surrender after reasonable requests.
Additionally, the bill clarifies that the exceptions do not limit the rights of other individuals within or outside the dwelling to respond to a forced entry, including the use of firearms as permitted by law. It also states that individuals defending their property from forced entry by a bail enforcer will not be liable for injuries caused to the enforcer, and property owners may seek damages for any harm caused by such forced entry. The bill is set to take effect on November 1, 2025.
