This bill establishes new regulations regarding the use of generative artificial intelligence (AI) in political advertisements and communications in Oklahoma. It defines generative AI as a machine-based system that can create synthetic content, such as images, videos, and text, based on human-defined objectives. The bill mandates that any political advertisement or media that includes content generated by AI and depicts a real person performing actions that did not occur must include a prominent disclosure stating, "Created in whole or in part with the use of generative artificial intelligence." Specific requirements for the visibility and audibility of this disclosure are outlined, ensuring it is easily readable or heard by the average viewer or listener.
Additionally, the bill allows candidates whose likenesses are depicted through generative AI to seek legal remedies, including injunctive relief or damages, against violators of the disclosure requirement. However, there are exceptions to these requirements for certain media, such as bona fide news broadcasts, paid broadcasts where good faith efforts were made to verify authenticity, and publications that clarify the AI-generated content does not accurately represent the candidate's actions. The act is set to take effect on November 1, 2025.
