This bill amends Section 962 of Title 47 of the Oklahoma Statutes, which pertains to the foreclosure of liens related to towing and wrecker services. The amendment allows individuals legally entitled to compensation for the removal, storage, or remediation at the scene of an accident of any vehicle subject to registration to have a possessory lien on that vehicle, with the lien arising upon possession. The bill specifies that any person perfecting a lien must follow the foreclosure provisions outlined in Sections 908 through 911 of the same title.
Additionally, the bill clarifies that the owner of a vehicle towed or stored is responsible for the total amount owed for services rendered. It also authorizes wrecker or towing services to collect fees from various parties, including the vehicle owner, lienholder, or insurer, as specified in Section 904. The act is set to take effect on November 1, 2025.
