While the act affirms the right to garden, it also allows municipalities, cities, or towns to enact content-neutral ordinances that regulate aspects of vegetable gardening, such as size and proximity to roadways or structures for health and safety reasons. Additionally, it permits the enforcement of existing lawful ordinances related to water usage, fertilizer application, and invasive species control, provided they do not specifically ban gardening. The act is set to take effect on November 1, 2025.
