Additionally, the bill allows for written consent from state, county, or other governmental entities to proceed with the detachment despite these restrictions.
The bill also maintains existing procedures for petitioning detachment, including the requirement for a true and complete unsigned copy of the petition to be filed before circulation, the timely filing of signed copies, and the publication of notices regarding the petition's sufficiency. The governing body of the municipality is required to hold a public hearing on the petition within ten days of publication. The act is set to take effect on November 1, 2025.
