Senate Bill No. 438 amends Section 1219.6 of Title 36 of the Oklahoma Statutes, which pertains to health insurance payment methods. The bill prohibits health insurance plans from restricting payment methods to only credit card payments and requires that if a health insurance plan or its vendor initiates or changes payments to a health care provider using a credit card, they must notify the provider of any associated fees and provide clear instructions on selecting a preferred payment method. Additionally, similar requirements are established for electronic funds transfer payments, including virtual credit card payments.
The bill also stipulates that health insurance plans using the Automated Clearing House Network to transmit payments cannot charge fees unless the health care provider has consented to them. It clarifies that any contractual clauses that conflict with these provisions are void and that violations will be enforced by the Insurance Commissioner. The act is set to take effect on November 1, 2025.
