Senate Bill No. 438 amends Section 1219.6 of Title 36 of the Oklahoma Statutes, which pertains to health insurance payment methods. The bill establishes that health insurance plans issued, amended, or renewed after January 1, 2020, cannot restrict payment methods to only credit card payments. It requires health insurers and their vendors to notify health care providers of any fees associated with payment methods and to provide clear instructions on selecting preferred payment options. Additionally, if payments are made through electronic funds transfer, similar notifications and instructions must be provided.
The bill also specifies that health insurers cannot charge fees solely for transmitting payments through the Automated Clearing House Network unless the health care provider has consented to such fees. It clarifies that any contractual clauses that conflict with these provisions are void, and violations will be enforced by the Insurance Commissioner. The act is set to take effect on November 1, 2025.
