This bill establishes new regulations regarding school employees who are under investigation, arrested, or charged with offenses against students, specifically those involving sexual abuse or exploitation. It mandates that law enforcement must notify the superintendent and the board of education of the employing school district or charter school when such incidents occur. Upon receiving this notification, the board is required to suspend the employee without notice or hearing, ensuring that the suspension does not affect the employee's compensation or benefits. The suspended employee is prohibited from being on school premises and cannot resign during the suspension period. The suspension may extend until the conclusion of any criminal trial, excluding the appeal process.
Additionally, the superintendent must inform the parents and legal guardians of students about the situation, including a statement that the employee is presumed innocent until proven guilty. The State Board of Education is tasked with creating rules to implement these provisions. The bill is set to take effect on July 1, 2025, and includes an emergency clause for immediate enforcement upon passage and approval.
