House Bill No. 1062, introduced by Luttrell, amends Section 2-121 of the Oklahoma Alcoholic Beverage Control Act to allow individuals aged eighteen and older to serve certain alcoholic beverages under specific conditions. The bill stipulates that while individuals under twenty-one cannot sell spirits, those who are eighteen or older may open and serve beer and wine from their original containers, as well as serve pre-mixed beer, wine, and spirits from a shaker tin prepared by a qualified employee aged twenty-one or older. Additionally, the bill clarifies that employees of special events, caterers (unless catering a mixed beverage-licensed premises), and airline/railroad beverage licensees are exempt from obtaining an employee license, along with employees of beer distributors who only sell to licensed establishments.
The bill also outlines the requirements for obtaining an employee license, including a minimum age of eighteen for most applicants and the completion of a training program approved by the ABLE Commission within fourteen days of initial licensure. The legislation mandates that proof of training must be available for inspection at the business location. Furthermore, if the ABLE Commission denies an employee license application, it is required to notify the applicant's employer at the same time as the applicant. The act is set to take effect on November 1, 2025.
