The bill amends Oklahoma law to enhance the responsibilities of the Legislative Office of Fiscal Transparency (LOFT) and improve the review process for administrative rules. It establishes a new division within LOFT focused on reviewing the Oklahoma Administrative Code and conducting rule impact analyses for "major rules" proposed by state agencies. These analyses must include a statement of need, legal basis, evaluation of costs and benefits, and examination of alternatives, and they must be publicly available and submitted to legislative leaders. Additionally, the bill modifies the approval process for emergency rules, transferring authority from the Governor to the Legislature, which must now approve emergency measures based on substantial evidence of necessity.

The bill also introduces new requirements for agencies regarding the preparation and submission of rule impact statements after proposed rule adoptions, mandating that these statements be submitted to LOFT for analysis. It outlines the necessary components of the rule impact statement, including the proposed rule's purpose, affected classes of persons, economic impacts, and potential effects on public health and safety. Furthermore, it clarifies that legislative approval of a major rule does not imply a grant or modification of statutory authority for rule promulgation and will not be part of the record in judicial proceedings concerning the rule. The bill is set to take effect on November 1, 2025.
