The Oklahoma Perfluoroalkyl and Polyfluoroalkyl Substances (PFAS) Act establishes regulations concerning the management and disposal of PFAS, which are harmful substances often found in aqueous film-forming foam (AFFF). The Act defines key terms related to PFAS and AFFF waste, and it provides an exemption from civil liability for certain passive receivers of PFAS, such as public water systems and municipalities, unless the release of PFAS results from a material violation of legal requirements or gross negligence. The Act also mandates the Environmental Quality Board to create rules for the receipt, storage, treatment, and disposal of PFAS, including a fee schedule for disposal applications.

Additionally, the Act requires that any entity seeking to handle more than 200 pounds of AFFF waste per day must obtain authorization from the Department of Environmental Quality. It stipulates that AFFF waste from other states must maintain its classification unless it poses a lesser risk to human health and the environment. If AFFF waste is banned from disposal in its state of origin, it is similarly banned in Oklahoma, unless the ban is due to a lack of permitted hazardous waste landfills. The Act is declared an emergency measure, taking effect immediately upon passage and approval.
