Senate Bill No. 40 amends existing laws regarding the transportation and storage of firearms in Oklahoma. It removes liability provisions for property owners, tenants, employers, and business entities that establish or enforce policies prohibiting individuals, except convicted felons, from transporting and storing firearms in locked motor vehicles on their property. The bill allows individuals to file civil actions against those who violate these provisions, with courts mandated to award damages, attorney fees, and enjoin further violations. Additionally, the bill clarifies that the term "motor vehicle" includes various types of vehicles required to be registered under the Oklahoma Vehicle License and Registration Act.
The bill also modifies the Oklahoma Self-Defense Act by ensuring that property owners and business entities cannot prohibit individuals from transporting, storing, or carrying firearms in their vehicles while conducting business. It establishes immunity from liability for those who do not restrict such actions, except in cases of gross negligence or willful misconduct. Furthermore, it clarifies that employees may transport firearms in their personal or rented vehicles while on business, and it specifies that carrying or discharging a weapon is not considered part of an employee's job description. The act is set to take effect on November 1, 2025.
