Senate Bill No. 40 amends existing laws regarding the transportation and storage of firearms in Oklahoma. It removes liability provisions for property owners, tenants, employers, or business entities that establish or enforce policies prohibiting individuals, except convicted felons, from transporting and storing firearms or ammunition in locked motor vehicles on their property. The bill clarifies that individuals may bring civil actions against those who violate these provisions, and if successful, the court will award damages, attorney fees, and enjoin further violations. Additionally, the bill defines "motor vehicle" and specifies that the provisions do not apply to claims under the Workers Compensation Act.
The bill also modifies the Oklahoma Self-Defense Act by clarifying the rights of property owners and business entities regarding the possession of weapons on their premises. It prohibits them from establishing policies that prevent individuals, except convicted felons, from transporting and storing firearms in locked motor vehicles while conducting business. Furthermore, it provides immunity from liability for those who do not prohibit individuals from carrying concealed or unconcealed weapons on their property, with certain exceptions for gross negligence or willful misconduct. The act is set to take effect on November 1, 2025.
