This bill amends the Teachers Due Process Act of 1990, specifically 70 O.S. 2021, Section 6-101.23, to authorize temporary contracts for teachers holding emergency or provisional certificates. It clarifies that the dismissal, suspension, and nonreemployment provisions of the Act do not apply to substitute teachers, adult education teachers, and those on temporary contracts. However, teachers on temporary contracts for a complete school year or those funded by federal or private grants will still be subject to certain evaluation provisions. Additionally, the bill stipulates that teachers who have worked a complete school year under a temporary contract will receive a year of service credit toward career status.
The bill also introduces a limitation on the duration of temporary contracts, stating that no teacher can be hired on such contracts for more than four semesters, with exceptions for teachers replacing those on approved leave, retired teachers, and those with emergency or provisional certificates. Furthermore, it mandates that school districts provide full written disclosure of the terms and conditions of temporary contracts at the time of the job offer. If this disclosure is not provided, the teacher will be considered employed on a continuing contract basis. The effective date of the bill is set for July 1, 2025, and it declares an emergency for immediate implementation upon passage and approval.
