If the birth of the baby poses a threat to the woman's life, an abortion may be performed.
Additionally, the bill establishes penalties for those who perform or attempt to perform an abortion unlawfully, classifying such actions as felonies punishable by fines up to $100,000 or imprisonment for up to ten years, or both. It clarifies that women cannot be charged with any criminal offense related to the death of their unborn child and allows for the use of contraceptives before pregnancy is detectable. An affirmative defense is also provided for licensed physicians who unintentionally cause harm to an unborn child while treating a pregnant woman. The bill declares an emergency, allowing it to take effect immediately upon passage and approval.
