7 An Act relating to civil procedure; prescribing
7 procedures related to civil actions for collection of
8 medical debts; prescribing requirements for petition;
8 requiring proof of compliance with Transparency in
9 Health Care Prices Act; prescribing procedures with
9 respect to entry of default judgments based upon
10 medical debt; requiring proof of compliance with
10 Transparency in Health Care Prices Act; providing for
11 codification; and providing an effective date.

15 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

16 SECTION 1. NEW LAW A new section of law to be codified
16
17 in the Oklahoma Statutes as Section 193 of Title 12, unless there is
17
18 created a duplication in numbering, reads as follows:

19 A. A creditor or debt collector or collection agency operating
19
20 on behalf of a creditor that files a civil action for recovery of a
20
21 medical debt shall attach to the petition or applicable form a copy
21
22 of redacted itemization of the charges that are the basis for the
22
23 medical debt and shall also attach proof of compliance with the

2 Title 63 of the Oklahoma Statutes.

3 B. Prior to entry of a default judgment against a consumer in a
3
4 legal action on a medical debt, in addition to compliance with the
4
5 applicable rules of the district court for entry of a default
5
6 judgment, the plaintiff shall file with the court evidence that
6
7 establishes the amount and nature of the medical debt and includes:
7
8 1. The original account number at charge-off;
8
9 2. The original creditor at charge-off;
9
10 3. The amount due at charge-off or if the balance has not been
10
11 charged off, an itemization of the amount claimed to be owed,
11
12 including the principal, interest, fees, and other charges or
12
13 reductions from payment made or other credits;
13
14 4. An itemization of post charge-off additions if any;
14
15 5. The date of the last payment, if applicable, or the date of
15
16 the last transaction; and
16
17 6. Proof of compliance with the Transparency in Health Care
17
18 Prices Act, Section 1-725.2 et seq. of Title 63 of the Oklahoma
18
19 Statutes.

20 SECTION 2. This act shall become effective November 1, 2024.
