7 An Act relating to state government finance; creating
7 the Federal Overreach and Extraordinary Litigation
8 Revolving Fund; placing the Fund under the control of
8 the Office of the Attorney General; establishing fund
9 characteristics and purpose; authorizing and limiting
9 budgeting and expenditure of funds; requiring certain
10 expenditure procedures; defining certain term;
10 providing for codification; providing an effective
11 date; and declaring an emergency.

14 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

15 SECTION 1. NEW LAW A new section of law to be codified
15
16 in the Oklahoma Statutes as Section 18q-1 of Title 74, unless there
16
17 is created a duplication in numbering, reads as follows:

18 A. There is hereby created in the State Treasury a revolving
18
19 fund for the Office of the Attorney General to be designated the
19
20 "Federal Overreach and Extraordinary Litigation Revolving Fund".
20
21 The fund shall be a continuing fund, not subject to fiscal year
21
22 limitations, and shall consist of all monies eligible and designated
22
23 for deposit by law. All monies accruing to the credit of the fund
23
24 are hereby appropriated and may be budgeted and expended by the

1 Office of the Attorney General for the purposes of addressing

2 federal overreach. Expenditures from said fund shall be made upon
2
3 warrants issued by the State Treasurer against claims filed as
3
4 prescribed by law with the Director of the Office of Management and
4
5 Enterprise Services for approval and payment.

6 B. For purposes of this section the term "addressing federal
6
7 overreach" includes efforts by the Office of the Attorney General
7
8 related to:
8
9 1. Duties assigned pursuant to paragraph 24 of subsection A of
9
10 Section 18b of Title 74 of the Oklahoma Statutes;
10
11 2. The State Reserved Powers Protection Unit created pursuant
11
12 to Section 18q of Title 74 of the Oklahoma Statutes; and
12
13 3. Extraordinary litigation and other expenses related to any
13
14 of the following: foreign threats, interstate crime, terrorist
14
15 organizations, gross violations of public trust, and statewide
15
16 public safety.

17 SECTION 2. This act shall become effective July 1, 2024.
17
18 SECTION 3. It being immediately necessary for the preservation
18
19 of the public peace, health or safety, an emergency is hereby
19
20 declared to exist, by reason whereof this act shall take effect and
20
21 be in full force from and after its passage and approval.
