7 An Act relating to the Oklahoma Tax Commission;
7 amending 68 O.S. 2021, Section 105.1, which relates
8 to designation of peace officer; modifying authority
8 to designate peace officer; prescribing duties;
9 requiring certain certification; eliminating certain
9 prohibition; prohibiting certain investigations; and
10 providing an effective date.

12 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

13 SECTION 1. AMENDATORY 68 O.S. 2021, Section 105.1, is
13
14 amended to read as follows:
14
15 Section 105.1. The Oklahoma Tax Commission shall have the
15
16 authority to designate as a peace officer the one (1) employee in
16
17 the position of Director of Internal Affairs for the purpose of
17
18 Safety and Security whose duties include conducting personnel
18
19 investigations, and background checks, and assisting with security
19
20 of Oklahoma Tax Commission facilities. An employee designated as a
20
21 peace officer pursuant to this section shall be certified pursuant
21
22 to Section 3311 of Title 70 of the Oklahoma Statutes and have the
22
23 authority to review information contained in the files of federal,
23
24 state, or local law enforcement officials in order to conduct the

1 investigations prescribed by this section. The employee designated

2 as a peace officer shall not be authorized to carry a firearm nor
2
3 shall be required to be certified pursuant to Section 3311 of Title
3
4 70 of the Oklahoma Statutes conduct any type of investigations
4
5 related to violations of the tax laws of this state which would also
5
6 include criminal investigations.

7 SECTION 2. This act shall become effective November 1, 2024.
