6 An Act relating to county jails; amending 57 O.S.
7 2021, Section 38, which relates to county jail
7 reimbursement rates; increasing amount of
8 reimbursement rate; deleting obsolete implementation
8 requirement; and providing an effective date.

11 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

12 SECTION 1. AMENDATORY 57 O.S. 2021, Section 38, is
12
13 amended to read as follows:
13
14 Section 38. The Department of Corrections shall reimburse any
14
15 county which is required to retain an inmate pursuant to
15
16 subsection E of Section 37 of this title in an amount not to
16
17 exceed Twenty-seven Dollars ($27.00) Twenty-eight Dollars
17
18 ($28.00) per day for each inmate during such period of
18
19 retention, unless the actual daily cost as determined by the
19
20 Department of Corrections Daily Rate as defined in this section,
20
21 exceeds Twenty-seven Dollars ($27.00) Twenty-eight Dollars
21
22 ($28.00). If the actual daily cost as determined by the
22
23 Department of Corrections Daily Rate exceeds Twenty-seven
23
24 Dollars ($27.00) Twenty-eight Dollars ($28.00), the county shall

1 notify the Department of Corrections of the actual daily cost no

2 later than September 30. If the county's actual daily cost is
2
3 accepted by the Department that shall be the reimbursement rate
3
4 for the county beginning the next fiscal year. If the
4
5 Department rejects the county's actual daily cost application,
5
6 then the actual daily cost reimbursement shall be determined by
6
7 the State Auditor and shall be imposed beginning the next fiscal
7
8 year. The Department shall distribute the reimbursement on a
8
9 monthly basis upon receipt and approval of a billing statement
9
10 from the county. The county shall use the reimbursement to
10
11 defray expenses of equipping and maintaining the jail and
11
12 payment of personnel. The provisions in this act shall be
12
13 implemented by the Department to allow sufficient time for
13
14 application to FY-2019. The Department of Corrections shall
14
15 reimburse the county for the emergency medical care for physical
15
16 injury or illness of the inmate retained under this act if the
16
17 injury or illness is directly related to the incarceration and
17
18 the county is required by law to provide such care for inmates
18
19 in the jail. The Department shall not pay fees for medical care
19
20 in excess of the rates established for Medicaid providers. The
20
21 state shall not be liable for medical charges in excess of the
21
22 Medicaid scheduled rate. The Director may accept any inmate
22
23 required to have extended medical care upon application of the
23
24 county.

1 SECTION 2. This act shall become effective November 1, 2024.
