7 An Act relating to state government; creating the
7 Oklahoma Tourism and Recreation Department State Park
8 Emergency Maintenance Fund; establishing an Eight
8 Year State Park Emergency Maintenance Plan;
9 specifying sources of revenue for the fund; providing
9 for expenditures from the fund; providing for
10 codification; providing an effective date; and
10 declaring an emergency.

14 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

15 SECTION 1. NEW LAW A new section of law to be codified
15
16 in the Oklahoma Statutes as Section 2254.3 of Title 74, unless there
16
17 is created a duplication in numbering, reads as follows:

18 A. There is hereby created in the State Treasury a revolving
18
19 fund for the Oklahoma Tourism and Recreation Department to be
19
20 designated the "Oklahoma Tourism and Recreation Department State
20
21 Park Emergency Maintenance Fund". The fund shall be a continuing
21
22 fund, not subject to fiscal year limitations, and shall consist of
22
23 all funds received by the Oklahoma Tourism and Recreation Department
23
24 for the purposes of executing the Eight Year State Park Emergency

1 Maintenance Plan, as defined in this section, and such other monies

2 accredited to the fund pursuant to law.

3 B. All monies accruing to the credit of the fund are hereby
3
4 appropriated and may be budgeted and expended by the Oklahoma
4
5 Tourism and Recreation Department for the purpose of executing the
5
6 Eight Year State Park Emergency Maintenance Plan, as defined in this
6
7 section; provided, no more than twenty percent (20%) of the amount
7
8 accruing annually shall be expended for the purpose of funding
8
9 operations.

10 C. No monies from this revolving fund shall be transferred for
10
11 any purpose to any other state agency. Expenditures from the fund
11
12 shall be made upon warrants issued by the State Treasurer against
12
13 claims filed as prescribed by law with the Director of the Office of
13
14 Management and Enterprise Services for approval and payment.
14
15 D. The Eight Year State Park Emergency Maintenance Plan is
15
16 identified in the Appendix of this section and is incorporated by
16
17 reference as if fully set out herein.

18 E. Any monies appropriated to the Oklahoma Tourism and
18
19 Recreation Department State Park Emergency Maintenance Fund shall
19
20 not result in a decrease in historic and traditional Oklahoma
20
21 Tourism and Recreation Department funding levels or be used to
21
22 supplant or replace existing state funds used for state park
22
23 maintenance purposes.

1 F. In order to ensure proper oversight of the funds deposited

2 in the Oklahoma Tourism and Recreation Department State Park
2
3 Emergency Maintenance Fund, the Oklahoma Tourism and Recreation
3
4 Department shall generate a report biannually identifying funds
4
5 expended and progress made on each project. The report shall be
5
6 promptly submitted to the Governor, the President Pro Tempore of the
6
7 Oklahoma State Senate, the Speaker of the Oklahoma House of
7
8 Representatives, and all members of the Oklahoma Tourism and
8
9 Recreation Commission.

10 SECTION 2. This act shall become effective July 1, 2024.

11 SECTION 3. It being immediately necessary for the preservation
11
12 of the public peace, health or safety, an emergency is hereby
12
13 declared to exist, by reason whereof this act shall take effect and
13
14 be in full force from and after its passage and approval.
