7 An Act relating to agricultural land; prohibiting
7 leasing of agricultural land by certain persons;
8 providing exception; requiring certain affidavit as
8 an attachment to lease; requiring promulgation of
9 certain form by Attorney General; requiring reversion
9 of leased land under certain circumstances; providing
10 exception to certain requirements; defining term;
10 providing for codification; and providing an
11 effective date.

14 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

15 SECTION 1. NEW LAW A new section of law to be codified
15
16 in the Oklahoma Statutes as Section 11-101 of Title 2, unless there
16
17 is created a duplication in numbering, reads as follows:

18 A. No alien or any person who is not a citizen of the United
18
19 States shall lease agricultural land in this state either directly
19
20 or indirectly through a business entity or trust, except as
20
21 hereinafter provided. Provided, however, the requirements of this
21
22 subsection shall not apply to a business entity that is engaged in
22
23 regulated interstate commerce in accordance with federal law.

1 B. On or after the effective date of this act, any lease for

2 agricultural land shall include as an exhibit to the lease an
2
3 affidavit executed by the person or entity leasing the land
3
4 attesting that the person, business entity, or trust is leasing the
4
5 land in compliance with the requirements of this section and that no
5
6 funding source is being used in violation of this section or any
6
7 other state or federal law. The Attorney General shall promulgate a
7
8 separate affidavit form for individuals and for business entities or
8
9 trusts to comply with the requirements of this section, with the
9
10 exception of those leases which the Attorney General deems necessary
10
11 when promulgating the affidavit form.

12 C. Any lease found to be in violation of this section shall
12
13 immediately be null and void and all rights to the leased
13
14 agricultural land shall immediately revert back to the lessor.
14
15 D. This section shall not apply to leases of agricultural land
15
16 to aliens who are or shall take up bona fide residence in this
16
17 state, and any alien who is or shall become a bona fide resident of
17
18 this state shall have the right to lease agricultural lands in this
18
19 state upon the same terms as citizens of the United States who
19
20 reside in this state during the continuance of such bona fide
20
21 residence of such alien in this state. Provided, that if such
21
22 resident alien shall cease to be a bona fide inhabitant of this
22
23 state, such lease for agricultural land shall be immediately null

1 and void and all rights to the leased agricultural land shall

2 immediately revert back to the lessor.

3 E. For the purposes of this section, “agricultural land” means
3
4 any real property that is used in the production of plants, fruits,
4
5 wood, or farm or ranch animals to be sold off the premises.
5
6 SECTION 2. This act shall become effective November 1, 2024.
