7 An Act relating to motor vehicles; defining term;
7 clarifying impact of use of certain systems on
8 employee status; providing for codification; and
8 providing an effective date.

11 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

12 SECTION 1. NEW LAW A new section of law to be codified
12
13 in the Oklahoma Statutes as Section 230.18 of Title 47, unless there
13
14 is created a duplication in numbering, reads as follows:

15 A. As used in this section, “motor carrier safety improvement”
15
16 means any device, equipment, software, technology, procedure,
16
17 training, policy, program, or operational practice intended and
17
18 primarily used to improve or facilitate compliance with traffic
18
19 safety or motor carrier safety laws, safety of a motor vehicle,
19
20 safety of the operator of a motor vehicle, or safety of third-party
20
21 users of public roadways.

22 B. The deployment, implementation, or use of a motor carrier
22
23 safety improvement by or as required by a motor carrier or its
23
24 related entity, including by contract, shall not be considered when

 1 evaluating an individual’s status as an employee or independent

2 contractor, or as a jointly employed employee, under any state law.

3 SECTION 2. This act shall become effective November 1, 2024.
