7 An Act relating to schools; amending 70 O.S. 2021,
7 Section 24-156, which relates to the Chase Morris
8 Sudden Cardiac Arrest Prevention Act; requiring
8 coaches of athletic activities to complete certain
9 training; requiring public schools to develop a
9 cardiac emergency response plan; providing for
10 contents of plan; updating statutory reference;
10 amending 70 O.S. 2021, Section 1210.200, which
11 relates to the Zachary Eckles and Luke Davis
11 Automated External Defibrillators in Schools Act;
12 requiring school districts that make automated
12 external defibrillators available to use certain
13 guidelines; updating statutory language; providing an
13 effective date; and declaring an emergency.

16 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
16
17 SECTION 1. AMENDATORY 70 O.S. 2021, Section 24-156, is
17
18 amended to read as follows:
18
19 Section 24-156. A. This act shall be known and may be cited as
19
20 the “Chase Morris Sudden Cardiac Arrest Prevention Act”.
20
21 B. As used in the Chase Morris Sudden Cardiac Arrest Prevention
21
22 Act, “athletic activity” means any sport sanctioned and offered in
22
23 grades seven through twelve by a school district.

1 C. The State Department of Health and the State Department of
1
2 Education shall jointly develop and post on their publicly
2
3 accessible websites guidelines and other relevant materials to
3
4 inform and educate students participating in or desiring to
4
5 participate in an athletic activity, their parents, and their
5
6 coaches about the nature and warning signs of sudden cardiac arrest,
6
7 including the risks associated with continuing to play or practice
7
8 after experiencing one or more symptoms of sudden cardiac arrest,
8
9 including unexplained fainting, difficulty breathing, chest pains,
9
10 dizziness, and abnormal racing heart rate. In developing the
10
11 guidelines and materials, the State Department of Health and the
11
12 State Department of Education may utilize existing materials
12
13 developed by other entities or organizations.

14 D. A student participating in or desiring to participate in an
14
15 athletic activity and the student’s parent or guardian shall, each
15
16 school year and prior to participation by the student in an athletic
16
17 activity, sign and return to the student’s school an acknowledgement
17
18 of receipt and review of a sudden cardiac arrest symptoms and
18
19 warning signs information sheet jointly developed by the State
19
20 Department of Health and the State Department of Education.
20
21 E. A school may hold an informational meeting prior to the
21
22 start of each athletic season for all ages of competitors regarding
22
23 the symptoms and warning signs of sudden cardiac arrest. In
23
24 addition to students, parents, coaches, and other school officials,

1 informational meetings may include physicians, pediatric

2 cardiologists, and athletic trainers.

3 F. A student who collapses or faints without a concurrent head
3
4 injury while participating in an athletic activity shall be removed
4
5 by the coach from participation at that time.
5
6 G. A student removed or prevented from participating in an
6
7 athletic activity pursuant to subsection F of this section shall not
7
8 return to participation until the student is evaluated and cleared
8
9 for return to participation in writing by a health care provider as
9
10 defined in Section 3090.2 of Title 63 of the Oklahoma Statutes.

11 H. Once each year, a coach of an athletic activity shall
11
12 complete the:
12
13 1. The sudden cardiac arrest training course offered by a
13
14 provider approved by the State Department of Health; and
14
15 2. Training in first aid, cardiopulmonary resuscitation, and
15
16 use of an automated external defibrillator. The training shall
16
17 follow guidelines set by a nationally recognized, guidelines-based
17
18 organization focused on emergency cardiovascular care.
18
19 A coach of an athletic activity shall not coach the athletic
19
20 activity until the coach completes the training course required
20
21 under this subsection.
21
22 I. Each public school in this state shall develop a sudden
22
23 cardiac emergency response plan. The plan shall be formulated by a

1 school site administrator and presented to the school district board

2 of education. The plan shall:

3 1. Establish and provide for membership of a sudden cardiac
3
4 emergency response team for each school site. Each team shall
4
5 include a school site administrator;
5
6 2. Activate the team in response to a sudden cardiac arrest;
6
7 3. Implement automated external defibrillator (AED) placement
7
8 and routine maintenance within the school as needed and dictated by
8
9 the plan and in accordance with guidelines set by a nationally
9
10 recognized, guidelines-based organization focused on emergency
10
11 cardiovascular care. The plan shall provide for implementation of
11
12 clearly marked and easily accessible AED placement;
12
13 4. Provide for communication and dissemination of the plan
13
14 throughout the school campus;
14
15 5. Require the response team to practice the plan by conducting
15
16 periodic drills;
16
17 6. Provide for coordination with emergency medical service
17
18 providers that serve the area in which the school is located;
18
19 7. Address athletic events and athletic facilities at each
19
20 middle school and high school site provided:
20
21 a. an AED shall be placed at each athletic venue or be
21
22 accessible within one to three minutes of each venue
22
23 where athletic practices or competitions are held, or
23

1 b. a mobile AED device shall be on the premises in
1
2 accordance with guidelines set by a nationally
2
3 recognized, guidelines-based organization focused on
3
4 emergency cardiovascular care;
4
5 8. Provide for appropriate school staff to be trained in first
5
6 aid, cardiopulmonary resuscitation, and the use of an AED in
6
7 accordance with guidelines set by a nationally recognized,
7
8 guidelines-based organization focused on emergency cardiovascular
8
9 care. The plan shall stipulate the appropriate staff to receive
9
10 training which shall include, but not be limited to, athletic
10
11 coaches, school nurses, and athletic trainers; and
11
12 9. Be reviewed by the school district board of education and
12
13 sudden cardiac emergency response team members and updated annually.
13
14 J. The sponsors of youth athletic activities not associated
14
15 with a school are encouraged to follow the guidance stated in the
15
16 Chase Morris Sudden Cardiac Arrest Prevention Act.
16
17 J. K. Nothing in the Chase Morris Sudden Cardiac Arrest
17
18 Prevention Act shall be construed to create, establish, expand,
18
19 reduce, contract, or eliminate any civil liability on the part of
19
20 any school or school employee.
20
21 K. L. The State Board of Health and the State Board of
21
22 Education shall promulgate rules to implement the provisions of this
22
23 act the Chase Morris Sudden Cardiac Arrest Prevention Act.

1 SECTION 2. AMENDATORY 70 O.S. 2021, Section 1210.200, is

2 amended to read as follows:
2
3 Section 1210.200. A. This act shall be known and may be cited
3
4 as the “Zachary Eckles and Luke Davis Automated External
4
5 Defibrillators in Schools Act.”.
5
6 B. Contingent upon the availability of federal funding or
6
7 donations from private organizations or persons made for this
7
8 purpose, each school district shall make automated external
8
9 defibrillators, as defined in Section 5A of Title 76 of the Oklahoma
9
10 Statutes, available at each school site in the district. The school
10
11 district may also make automated external defibrillators available
11
12 at each high school athletic practice or competition in the
12
13 district.
13
14 C. A school district that makes automated external
14
15 defibrillators available in schools or on school district property
15
16 pursuant to this section shall use the guidelines set by a
16
17 nationally recognized, guidelines-based organization focused on
17
18 emergency cardiovascular care in determining placement of automated
18
19 external defibrillators on school district property and their
19
20 routine maintenance needs.
20
21 D. Any school district that makes automated external
21
22 defibrillators available in schools or on school district property
22
23 shall be immune from civil liability for personal injury which
23
24 results from the use of the device, except for acts of gross

1 negligence or willfull willful wanton misconduct in accordance with
1
2 Section 5A of Title 76 of the Oklahoma Statutes.

3 D. E. The State Department of Education shall develop and make
3
4 available to school districts a list of private organizations or
4
5 persons willing to make donations or that have resources available
5
6 to schools for this purpose, federal programs or grants, and any
6
7 other source of funding that school districts may use to purchase
7
8 automated external defibrillators. The Department shall also
8
9 provide public recognition for private organizations or persons that
9
10 provide funding to school districts for the purpose of purchasing
10
11 automated external defibrillators.
11
12 SECTION 3. This act shall become effective July 1, 2024.
12
13 SECTION 4. It being immediately necessary for the preservation
13
14 of the public peace, health, or safety, an emergency is hereby
14
15 declared to exist, by reason whereof this act shall take effect and
15
16 be in full force from and after its passage and approval.
