1 STATE OF OKLAHOMA 1 2 2nd Session of the 59th Legislature (2024) 2 3 SENATE BILL 1922 By: Haste 3 4 4 5 5 6 AS INTRODUCED 6 7 An Act relating to license plates; amending 47 O.S. 7 2021, Sections 1137.1, as last amended by Section 1, 8 Chapter 262, O.S.L. 2023, 1137.2, as amended by 8 Section 171, Chapter 282, O.S.L. 2022, and 1137.3, as 9 last amended by Section 2, Chapter 262, O.S.L. 2023 9 (47 O.S. Supp. 2023, Sections 1137.1, 1137.2, and 10 1137.3), which relate to the issuance of temporary 10 license plates; updating statutory language; 11 modifying information to be shown on temporary 11 license plates; granting certain authorization; 12 granting rulemaking powers to certain bodies; setting 12 requirements for certain vendors; setting 13 requirements for temporary license plates; providing 13 for codification; and providing an effective date. 14 14 15 15 16 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: 16 17 SECTION 1. AMENDATORY 47 O.S. 2021, Section 1137.1, as 17 18 last amended by Section 1, Chapter 262, O.S.L. 2023 (47 O.S. Supp. 18 19 2023, Section 1137.1), is amended to read as follows: 19 20 Section 1137.1. A. Except for vehicles, travel trailers, or 20 21 commercial trailers which display a current Oklahoma license tag, 21 22 upon the purchase or transfer of ownership of a used motor vehicle, 22 23 travel trailer, or commercial trailer, including an out-of-state 23 24 purchase or transfer of the same, to a licensed used motor vehicle 24 Req. No. 2972 Page 1 1 dealer, wholesale used motor vehicle dealer, used travel trailer 1 2 dealer, or used commercial trailer dealer, subsequently referred to 2 3 in this section as “dealer”, the dealer shall affix a used dealer’s 3 4 plate visible from the rear of the vehicle, travel trailer, or 4 5 commercial trailer. Such license plate shall expire on December 31 5 6 of each year. When the vehicle, travel trailer, or commercial 6 7 trailer is parked on the dealer’s licensed place of business, it 7 8 shall not be required to have a license plate of any kind affixed. 8 9 A dealer shall obtain from Service Oklahoma at a cost of Ten Dollars 9 10 ($10.00) a dealer license plate for demonstrating, transporting, or 10 11 any other normal business of a dealer including use by an individual 11 12 holding a valid salesperson’s license issued by the Oklahoma Used 12 13 Motor Vehicle and Parts, Dismantler, and Manufactured Housing 13 14 Commission. Any dealer who operates a wrecker or towing service 14 15 licensed pursuant to Sections 951 through 957 of this title shall 15 16 register each wrecker vehicle and display a wrecker license plate on 16 17 each vehicle as required by Section 1134.3 of this title. A dealer 17 18 may obtain as many additional license plates as may be desired upon 18 19 the payment of Ten Dollars ($10.00) for each additional license 19 20 plate. Use of the used dealer license plate by a licensed dealer 20 21 for other than the purposes as set forth herein shall constitute 21 22 grounds for revocation of the dealer’s license. Service Oklahoma 22 23 shall design the official used dealer license plate to include the 23 24 used dealer’s license number issued to him or her each year by 24 Req. No. 2972 Page 2 1 Service Oklahoma or the Oklahoma Used Motor Vehicle and Parts, 1 2 Dismantler, and Manufactured Housing Commission. 2 3 B. Upon the purchase or transfer of ownership of an out-of- 3 4 state used motor vehicle, travel trailer, or commercial trailer to a 4 5 licensed dealer, the dealer shall make application for an Oklahoma 5 6 certificate of title pursuant to the Oklahoma Vehicle License and 6 7 Registration Act, Section 1101 et seq. of this title. Upon receipt 7 8 of the Oklahoma certificate of title, the dealer shall follow the 8 9 procedure as set forth in subsection A of this section. Provided, 9 10 nothing in this title shall be construed as requiring a dealer to 10 11 register a used motor vehicle, travel trailer, or commercial trailer 11 12 purchased in another state which will not be operated or sold in 12 13 this state. 13 14 C. Upon sale or transfer of ownership of the used motor vehicle 14 15 or travel trailer, the dealer shall place upon the reassignment 15 16 portion of the certificate of title a tax stamp issued by the county 16 17 treasurer of the county in which the dealer has his or her primary 17 18 place of business. The tax stamp shall be issued upon payment of a 18 19 fee of Three Dollars and fifty cents ($3.50) and shall be in lieu of 19 20 the dealer’s ad valorem tax on the inventories of used motor 20 21 vehicles or travel trailers but shall not relieve any other property 21 22 of the dealer from ad valorem taxation. 22 23 D. Upon sale of a used motor vehicle or travel trailer to 23 24 another licensed dealer, the selling dealer shall place the tax 24 Req. No. 2972 Page 3 1 stamp required in subsection C of this section upon the certificate 1 2 of title. The used dealer license plate or wholesale dealer license 2 3 plate shall be removed by the selling dealer. The purchasing dealer 3 4 shall, at time of purchase, place his or her dealer license plate on 4 5 the used motor vehicle, travel trailer, or commercial trailer as 5 6 provided in subsection A of this section; provided, for vehicles, 6 7 travel trailers, or commercial trailers purchased by a licensed used 7 8 dealer at an auction, in lieu of such placement of the dealer 8 9 license plate, the auction may provide temporary documentation as 9 10 approved by the Director of the Motor Vehicle Division of Service 10 11 Oklahoma for the purpose of transporting such vehicle to the 11 12 purchaser’s point of destination. Such temporary documentation 12 13 shall be valid for two (2) days following the date of sale. 13 14 E. The purchaser of every used motor vehicle, travel trailer, 14 15 or commercial trailer, except as otherwise provided by law, shall 15 16 obtain registration and title for the vehicle or trailer within two 16 17 (2) months from the date of purchase of same. It shall be the 17 18 responsibility of the selling dealer to place a temporary license 18 19 plate, in size similar to the permanent Oklahoma license plate but 19 20 of a weatherproof plastic-impregnated substance approved by the 20 21 Oklahoma Used Motor Vehicle and Parts, Dismantler, and Manufactured 21 22 Housing Commission, upon a used motor vehicle, travel trailer, or 22 23 commercial trailer when a transaction is completed for the sale of 23 24 said such vehicle. The temporary license plate under this 24 Req. No. 2972 Page 4 1 subsection shall be placed at the location provided for the 1 2 permanent motor vehicle license plate. The temporary license plate 2 3 shall show the license number which is issued to the dealer each 3 4 year by Service Oklahoma or the Used Motor Vehicle and Parts 4 5 Commission, the date the used motor vehicle, travel trailer, or 5 6 commercial trailer was purchased and the company name of the selling 6 7 dealer information required pursuant to Section 4 of this act. The 7 8 Oklahoma Used Motor Vehicle and Parts, Dismantler, and Manufactured 8 9 Housing Commission is hereby directed to develop the temporary 9 10 license plate design to incorporate these such requirements in a 10 11 manner that will permit law enforcement personnel to readily 11 12 identify the dealer license number and date of the vehicle purchase. 12 13 The Oklahoma Used Motor Vehicle and Parts, Dismantler, and 13 14 Manufactured Housing Commission is hereby authorized to develop 14 15 additional requirements and parameters as deemed appropriate to 15 16 discourage or prevent illegal duplication and use of the temporary 16 17 license plate. Such temporary license plate shall be valid for a 17 18 period of two (2) months from the date of purchase. Use of the 18 19 temporary license by a dealer for other than the purposes set forth 19 20 herein shall constitute grounds for revocation of the dealer’s 20 21 license to conduct business. Purchasers of a commercial trailer 21 22 shall affix the temporary license plate to the rear of the 22 23 commercial trailer. The purchaser shall display the temporary 23 24 24 Req. No. 2972 Page 5 1 license plate for a period not to exceed two (2) months or until 1 2 registration and title are obtained as provided in this section. 2 3 The provisions of this subsection on temporary licenses shall 3 4 apply to nonresidents who purchase a used motor vehicle, travel 4 5 trailer, or commercial trailer within this state that is to be 5 6 licensed in another state. The nonresident purchaser shall be 6 7 allowed to operate the vehicle or trailer within the state with a 7 8 temporary license plate for a period not to exceed two (2) months 8 9 from date of purchase. Any nonresident purchaser found to be 9 10 operating a used motor vehicle, travel trailer, or commercial 10 11 trailer within this state after two (2) months shall be subject to 11 12 the registration fees of this state upon the same terms and 12 13 conditions applying to residents of this state. 13 14 F. It shall be unlawful for any dealer to procure the 14 15 registration and licensing of any used motor vehicle, travel 15 16 trailer, or commercial trailer sold by the dealer or to act as the 16 17 agent for the purchaser in the procurement of the registration and 17 18 licensing of the purchaser’s used vehicle, travel trailer, or 18 19 commercial trailer. A license of any dealer violating the provision 19 20 of this section may be revoked. 20 21 G. Dealers following the procedure set forth herein shall not 21 22 be required to register vehicles, travel trailers, or commercial 22 23 trailers to which this section applies, nor will the registration 23 24 fee otherwise required be assessed. Provided, dealers shall not 24 Req. No. 2972 Page 6 1 purchase or trade for a used motor vehicle, travel trailer, or 1 2 commercial trailer on which the registration therefor has been 2 3 expired for a period exceeding two (2) months without obtaining 3 4 current registration therefor. 4 5 H. A nonprofit charitable organization which is exempt from 5 6 taxation pursuant to the provisions of the Internal Revenue Code, 26 6 7 U.S.C., Section 501(c)(3), and which accepts donations of used motor 7 8 vehicles previously titled in Oklahoma to be subsequently 8 9 transferred to another owner, upon the qualifying organization 9 10 providing sufficient documentation of its tax-exempt status, may 10 11 obtain from Service Oklahoma charitable nonprofit organization 11 12 license plates for demonstrating, transporting, or test-driving 12 13 donated vehicles, provided that no organization shall possess or use 13 14 at any one time more than eight such plates. Service Oklahoma shall 14 15 design distinctive license plates for that purpose. The cost for 15 16 said such plates shall be the same as provided in subsection A of 16 17 this section for dealer plates. 17 18 I. The transfer of ownership from the vehicle donor to the 18 19 qualifying nonprofit organization described in subsection H of this 19 20 section shall be made without the payment of motor vehicle excise 20 21 tax levied pursuant to Section 2103 of Title 68 of the Oklahoma 21 22 Statutes. 22 23 23 24 24 Req. No. 2972 Page 7 1 SECTION 2. AMENDATORY 47 O.S. 2021, Section 1137.2, as 1 2 amended by Section 171, Chapter 282, O.S.L. 2022 (47 O.S. Supp. 2 3 2023, Section 1137.2), is amended to read as follows: 3 4 Section 1137.2. Service Oklahoma The Oklahoma Motor Vehicle 4 5 Commission and the Oklahoma Used Motor Vehicle, Dismantler, and 5 6 Manufactured Housing Commission shall have the sole authority to 6 7 grant the power to issue the dealer license plate specified in 7 8 subsection A of Section 1137.1 of this title to authorized temporary 8 9 license plate vendors, pursuant to the provisions of Section 4 of 9 10 this act. 10 11 SECTION 3. AMENDATORY 47 O.S. 2021, Section 1137.3, as 11 12 last amended by Section 2, Chapter 262, O.S.L. 2023 (47 O.S. Supp. 12 13 2023, Section 1137.3), is amended to read as follows: 13 14 Section 1137.3. The purchaser of every new motor vehicle, 14 15 travel trailer, or commercial trailer shall register or license the 15 16 same within two (2) months from the date of purchase. It shall be 16 17 the responsibility of the selling dealer to place a temporary 17 18 license plate, in size similar to the permanent Oklahoma license 18 19 plate but of a weatherproof plastic-impregnated substance approved 19 20 by the Oklahoma Motor Vehicle Commission, upon a new motor vehicle, 20 21 travel trailer, or commercial trailer when a transaction is 21 22 completed for the sale of said such vehicle or trailer. Except for 22 23 cab and chassis trucks, the temporary license plate under this 23 24 section shall be placed at the location provided for the permanent 24 Req. No. 2972 Page 8 1 motor vehicle license plate. The purchaser of a new cab and chassis 1 2 truck may place the temporary license plate under this section in 2 3 the rear window. Said Such temporary license plate shall show the 3 4 dealer’s license number which is issued to him or her each year by 4 5 Service Oklahoma, the date the new motor vehicle, travel trailer or 5 6 commercial trailer was purchased and the company name of the selling 6 7 dealer information required pursuant to Section 4 of this act. The 7 8 Oklahoma Motor Vehicle Commission is hereby directed to develop a 8 9 temporary license plate design to incorporate these requirements in 9 10 a manner that will permit law enforcement personnel to readily 10 11 identify the dealer license number and date of the vehicle purchase. 11 12 The Oklahoma Motor Vehicle Commission is further authorized to 12 13 develop additional requirements and parameters designed to 13 14 discourage or prevent illegal duplication and use of the temporary 14 15 license plate. On or before two (2) months from the date of 15 16 purchase of a new motor vehicle, travel trailer, or commercial 16 17 trailer, said such temporary license plate shall be removed and 17 18 replaced with a permanent, current Oklahoma license plate. Use of 18 19 said such temporary license plate by a licensed dealer for other 19 20 than the purpose of normally doing business shall constitute grounds 20 21 for revocation of the dealer’s license. 21 22 It shall be unlawful for any licensed dealer of new motor 22 23 vehicles, travel trailers, or commercial trailers to procure the 23 24 registration and licensing of any new motor vehicle, travel trailer, 24 Req. No. 2972 Page 9 1 or commercial trailer sold by such licensed dealer or to act as the 1 2 agent for such purchaser in the procurement of said such 2 3 registration and licensing. The license of any licensed dealer of 3 4 new motor vehicles, travel trailers, or commercial trailers 4 5 violating the provisions of this section shall be revoked. 5 6 SECTION 4. NEW LAW A new section of law to be codified 6 7 in the Oklahoma Statutes as Section 1137.4 of Title 47, unless there 7 8 is created a duplication in numbering, reads as follows: 8 9 A. The Oklahoma Motor Vehicle Commission and the Oklahoma Used 9 10 Motor Vehicle, Dismantler, and Manufactured Housing Commission shall 10 11 have the power and duty to promulgate rules and procedures to 11 12 designate and register authorized temporary license plate vendors in 12 13 this state. Such vendors shall: 13 14 1. Provide pre-printed temporary license plates to dealers 14 15 licensed by the Oklahoma Motor Vehicle Commission and the Oklahoma 15 16 Used Motor Vehicle, Dismantler, and Manufactured Housing Commission; 16
