7 An Act relating to prescription drug reimbursement;
7 defining term; directing payment of certain co-
8 payment by insured under certain circumstances;
8 requiring certain health benefit plans to include
9 certain provisions in plans to be issued or renewed;
9 providing for codification; and providing an
10 effective date.

13 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

14 SECTION 1. NEW LAW A new section of law to be codified
14
15 in the Oklahoma Statutes as Section 3634.7 of Title 36, unless there
15
16 is created a duplication in numbering, reads as follows:

17 A. As used in this section, “health benefit plan” shall have
17
18 the same meaning as defined pursuant to Section 6060.4 of Title 36
18
19 of the Oklahoma Statues.

20 B. For any health benefit plan which covers prescription drug
20
21 reimbursement and is issued or renewed on or after the effective
21
22 date of this act, a patient shall only be responsible for the
22
23 payment of the applicable co-payment amount listed in the patient’s
23
24 policy when the prescription drug claim satisfies the following:

1 1. The reimbursement rate for the claim does not cover the

2 entire cost of the drug and any dispensing fees incurred; and

3 2. There is one insurer providing sole reimbursement for the
3
4 claim.

5 C. For any health benefit plan which covers prescription drug
5
6 reimbursement and is issued or renewed on or after the effective
6
7 date of this act, all listed co-payments for prescription drug
7
8 reimbursement shall include the cost of the prescription drug plus
8
9 an average cost of dispensing as recognized by the pharmaceutical
9
10 industry.

11 SECTION 2. This act shall become effective November 1, 2024.
