7 An Act relating to motor vehicles; amending 47 O.S.
7 2021, Section 11-1103, which relates to riding
8 motorcycles; making exception for certain
8 motorcycles; defining term; allowing for lane
9 filtering under certain conditions; and providing
9 effective date.

14 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

15 SECTION 1. AMENDATORY 47 O.S. 2021, Section 11-1103, is
15
16 amended to read as follows:
16
17 Section 11-1103. A. No person under the age of sixteen (16)
17
18 years shall drive a motorcycle, motor-driven cycle, motorized
18
19 scooter, or motorized bicycle on any highway of this state while
19
20 transporting any other person.
20
21 B. The operator of a motorcycle, motor-driven cycle, motorized
21
22 scooter, or motorized bicycle who has attained the age of sixteen
22
23 (16) years or older may carry a passenger if the vehicle has a wheel

1 diameter of twelve (12) inches or greater and is factory-designed

2 and equipped with either:
2
3 1. A double seating device with double foot rests; or
3
4 2. A sidecar attachment providing a separate seat space within
4
5 such sidecar attachment for each person riding therein so that such
5
6 person shall be seated entirely within the body of said sidecar.
6
7 C. No rider of a motorcycle, motor-driven cycle, motorized
7
8 scooter, or motorized bicycle shall hold to any moving vehicle for
8
9 the purpose of being propelled.

10 D. No Except as otherwise provided by subsection E of this
10
11 section, no driver of a motorcycle, motor-driven cycle, motorized
11
12 scooter, motorized bicycle, or electric-assisted bicycle shall pass
12
13 other vehicles between lanes of traffic traveling in the same
13
14 direction. This subsection shall not apply to the operator of an
14
15 authorized emergency vehicle.

16 E. 1. As used in this subsection, the term "lane filtering"
16
17 means the act of a two-wheeled motorcycle overtaking and passing
17
18 another vehicle or vehicles that are stopped in the same lane and
18
19 direction of travel as the overtaking motorcycle.
19
20 2. An operator of a two-wheeled motorcycle may engage in lane
20
21 filtering when:
21
22 a. the operator of the motorcycle is on a roadway with
22
23 lanes that are wide enough to pass safely,

1 b. the overtaking motorcycle is not operated at a speed
1
2 in excess of ten (10) miles per hour when overtaking
2
3 or passing the stopped vehicle or vehicles, and
3
4 c. conditions permit continued reasonable and prudent
4
5 operation of the motorcycle while lane filtering.
5
6 SECTION 2. This act shall become effective November 1, 2024.
