7 An Act relating to feral swine; amending 2 O.S. 2021,
7 Sections 6-609 and 6-611, which relate to the Feral
8 Swine Control Act; limiting transportation of feral
8 swine; limiting the release of feral swine; and
9 providing an effective date.

13 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

14 SECTION 1. AMENDATORY 2 O.S. 2021, Section 6-609, is
14
15 amended to read as follows:
15
16 Section 6-609 A. The State Board of Agriculture shall
16
17 promulgate rules for the testing and intrastate movement of live
17
18 feral swine.
18
19 B. All persons that transport live feral swine in this state
19
20 shall be required to obtain a transporter license from the Oklahoma
20
21 Department of Agriculture, Food, and Forestry.
21
22 C. Live feral swine shall only be transported to the following:
22
23 1. A licensed sporting facility;
23
24 2. A licensed handling facility;

1 3. 2. Directly to an approved slaughter facility; or.

2 4. Pursuant to an order issued by the State Veterinarian.

3 SECTION 2. AMENDATORY 2 O.S. 2021, Section 6-611, is
3
4 amended to read as follows:

5 Section 6-611. A. No person shall intentionally or knowingly
5
6 release or engage in, sponsor, instigate, assist, or profit from the
6
7 release of any hog, boar, swine, or pig to live in a wild or feral
7
8 state upon public or private lands, except for:
8
9 1. Release into a licensed sporting facility pursuant to the
9
10 Feral Swine Control Act; or
10
11 2. When when utilizing the Judas pig tagging system, release
11
12 onto the same private land on which a feral hog was trapped or
12
13 caught. In order to come under the release authorization of this
13
14 paragraph, the release must occur within twenty-four (24) hours of
14
15 the capture of the hog.

16 B. No person shall knowingly or intentionally violate the
16
17 importation, testing, permitting, licensing, and transportation
17
18 requirements contained in the Feral Swine Control Act and rules
18
19 promulgated thereto.
19
20 C. Any person violating the provisions of this section is
20
21 guilty of a felony and subject to a maximum punishment of two
21
22 (2) years in prison, a fine of Two Thousand Dollars ($2,000.00),
22
23 or both fine and imprisonment.

1 SECTION 3. This act shall become effective November 1, 2024.
