7 An Act relating to motor vehicles; amending 47 O.S.
7 2021, Section 11-309, which relates to driving on
8 roadways laned for traffic; requiring the overtaking
8 and passing another vehicle to be performed
9 expeditiously; setting time limit to complete act;
9 setting penalty for violations; and providing an
10 effective date.

13 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

14 SECTION 1. AMENDATORY 47 O.S. 2021, Section 11-309, is
14
15 amended to read as follows:
15
16 Section 11-309. Whenever any roadway has been divided into two
16
17 or more clearly marked lanes for traffic, the following requirements
17
18 in addition to all others consistent herewith shall apply.
18
19 1. A vehicle shall be driven as nearly as practicable entirely
19
20 within a single lane.
20
21 2. A vehicle shall not be moved from the lane until the driver
21
22 has first ascertained that the movement can be made with safety and
22
23 then given a signal, not less than the last one hundred (100) feet
23
24 traveled by the vehicle, of his or her intention to change lanes.

 1 3. Upon a roadway which is divided into three lanes, a vehicle
1
2 shall not be driven in the center lane except when overtaking and
2
3 passing another vehicle where the roadway is clearly visible and the
3
4 center lane is clear of traffic within a safe distance, or in
4
5 preparation for a left turn or where the center lane is at the time
5
6 allocated exclusively to traffic moving in the direction the vehicle
6
7 is proceeding and is signposted to give notice of the allocation.

8 4. A two-way left-turn lane is a lane near the center of the
8
9 highway set aside for use by vehicles making left turns in both
9
10 directions from or into the roadway. Two-way left-turn lanes shall
10
11 be designated by distinctive roadway markings consisting of parallel
11
12 double yellow lines, interior line dashed and exterior line solid,
12
13 on each side of the lane. A vehicle shall not be driven in a
13
14 designated two-way left-turn lane except when preparing for or
14
15 making a left turn from or into a roadway. Vehicles turning left
15
16 from the roadway shall not be driven in the two-way left-turn lane
16
17 for more than two hundred (200) feet while preparing for and making
17
18 the turn. A vehicle turning left onto the roadway may utilize the
18
19 two-way left-turn lane as a staging area by stopping and waiting for
19
20 traffic proceeding in the same direction to clear before merging
20
21 into the adjacent lanes of travel. A left turn shall not be made
21
22 from any other lane where a two-way left-turn lane has been
22
23 designated. Provided, however, this section shall not prohibit

 1 driving across a two-way left-turn lane when moving from a service

2 drive onto such marked roadway.

3 5. A vehicle shall not be driven in the left lane of a roadway
3
4 except when overtaking and passing another vehicle; provided. The
4
5 act of overtaking and passing another vehicle shall be performed
5
6 expeditiously. Larger vehicles, such as a tractor trailer, shall be
6
7 limited to two (2) minutes to complete the act of overtaking and
7
8 passing another vehicle. Smaller vehicles shall complete the act of
8
9 overtaking and passing of a vehicle within one (1) minute.

10 Provided, however, this paragraph shall not prohibit driving in the
10
11 left lane when traffic conditions, flow or road configuration, such
11
12 as the potential of merging traffic, require the use of the left
12
13 lane to maintain safe traffic conditions; provided further, this
13
14 paragraph shall not prohibit driving in the left lane of a roadway
14
15 within the city limits of a municipality or upon a county road as
15
16 long as such roadway is not part of the National System of
16
17 Interstate and Defense Highways or a turnpike. Upon conviction for
17
18 a violation of this paragraph, the maximum penalty shall be set at
18
19 Two Hundred Fifty Dollars ($250.00).

20 6. Official signs may be erected directing slow-moving traffic
20
21 to use a designated lane or designating those lanes to be used by
21
22 traffic moving in a particular direction regardless of the center of
22
23 the roadway, and drivers of vehicles shall obey the directions of
23
24 every such sign.

 1 Any person convicted of violating any provision of paragraph 1,
1
2 2, 3, 4, or 6 of this section shall be punished as provided for in
2
3 Section 17-101 of this title.

4 SECTION 2. This act shall become effective November 1, 2024.
