7 An Act relating to the use of public lands; defining
7 term; prohibiting certain use of public lands;
8 designating certain action as a misdemeanor; allowing
8 for certain process for first violations; providing
9 for codification; and providing an effective date.

12 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

13 SECTION 1. NEW LAW A new section of law to be codified
13
14 in the Oklahoma Statutes as Section 1096 of Title 64, unless there
14
15 is created a duplication in numbering, reads as follows:

16 A. As used in this section, “unauthorized camp” means any tent,
16
17 shelter, or bedding constructed or arranged for the purpose of or in
17
18 such a way to permit overnight use on a property not designated as a
18
19 campsite.

20 B. Persons may not use public rights-of-way or state-owned
20
21 lands for the purposes of establishing an unauthorized camp.

22 C. Any person who violates the provisions of this section
22
23 commits a misdemeanor punishable as provided in Section 10 of Title
23
24 21 of the Oklahoma Statutes. However, a person who commits a first

1 violation of this section shall be issued a warning, and a citation

2 may not be issued unless the person refuses any assistance offered
2
3 to them by the arresting officer. Such assistance may include, but
3
4 is not limited to, transportation to a shelter, food pantry, or
4
5 other place where resources are made available to assist the
5
6 indigent and homeless.

7 SECTION 2. This act shall become effective November 1, 2024.
