7 An Act relating to schools; defining term; requiring
7 certain schools to make menstrual products available
8 at no costs to students; providing for easily
8 accessible location of products; directing adoption
9 of certain policies and procedures; requiring
9 submission of annual report to the State Department
10 of Education; authorizing State Board of Education to
10 promulgate rules; providing for codification; and
11 providing an effective date.

14 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

15 SECTION 1. NEW LAW A new section of law to be codified
15
16 in the Oklahoma Statutes as Section 1-116.4 of Title 70, unless
16
17 there is created a duplication in numbering, reads as follows:

18 A. As used in this section, "menstrual products" means tampons
18
19 and sanitary napkins for use in connection with the menstrual cycle
19
20 that conform with applicable industry standards.

21 B. Every public school or charter school in the state with
21
22 grades below grade six shall make menstrual products available at no
22
23 cost to students, in at least one neutral location easily accessible
23
24 to all students that does not stigmatize any student seeking the

1 products, such as a school nurse's office or administrative office,

2 as appropriate.

3 C. Every public school or charter school in the state with
3
4 grades six through twelve shall make menstrual products available at
4
5 no cost to students, in easily accessible locations that do not
5
6 stigmatize any student seeking such products, including in the
6
7 school bathrooms. This shall include all female, gender-neutral,
7
8 and standalone handicapped bathrooms accessed by students in grades
8
9 six through twelve, as well as a neutral location, such as a school
9
10 nurse's office or administrative office, as appropriate.

11 D. Every school district board of education and public charter
11
12 school governing board shall adopt policies and procedures:

13 1. To ensure menstrual products are available and provided at
13
14 no cost to all students who need them. The policies shall include a
14
15 process by which students can provide grievances or other complaints
15
16 about lack of access to or quality of menstrual products; and
16
17 2. To inform students of the availability of menstrual products
17
18 as provided in this section by including the policies and procedures
18
19 adopted pursuant to this section in any student handbook and posting
19
20 the policies and procedures on school websites and locations in the
20
21 school where notices are commonly posted, including student
21
22 bathrooms and school nurses' offices.

23 E. No later than thirty (30) days following the end of each
23
24 fiscal year, every school district and charter school shall submit a

1 report to the State Department of Education containing the number of

2 menstrual products purchased in the preceding fiscal year, the
2
3 number of menstrual products distributed to students in the
3
4 preceding year, and any grievances or other complaints about lack of
4
5 access to or quality of menstrual products. The reports shall be
5
6 made available for public inspection.

7 F. The State Board of Education shall promulgate rules to
7
8 implement the provisions of this section.
8
9 SECTION 2. This act shall become effective November 1, 2024.
