7 Section 11-103.6a, which relates to adoption and
8 review of subject matter standards; deleting
8 requirement to review standards within certain time
9 frame; requiring standards changes to be made one
9 year prior to certain textbook adoption cycle;
10 prescribing legislative review and approval of
10 certain standards; providing an exception; allowing
11 minor technical changes in specified cases; providing
11 process for State Board of Education to review
12 standards; requiring review process to include three
12 committees and a public comment period; establishing
13 powers and duties of committees; mandating process
13 for receiving and reviewing public comments;
14 providing for implementation of certain standards
14 during review process; deleting certain outdated
15 comparison standards report; directing Board to
15 update certain frameworks; providing an effective
16 date; and declaring an emergency.

20 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
20
21 SECTION 1. AMENDATORY 70 O.S. 2021, Section 11-103.6a,
21
22 is amended to read as follows:
22
23 Section 11-103.6a A. Beginning with the 2014-15 2024-2025
23
24 school year, each area of subject matter standards, except for

1 standards for career and technology education adopted pursuant to
1
2 Section 14-103 of this title, shall be adopted by the State Board of
2
3 Education and shall be subject to legislative review and approval as
3
4 provided for in Section 4 11-103.6a-1 of this act title. The
4
5 subject matter standards provided in Section 11-103.6 of this title
5
6 shall be implemented statewide by every public school district in
6
7 this state. The subject matter standards shall be thoroughly
7
8 reviewed by the State Board every six (6) years according to and in
8
9 coordination with the existing subject area textbook adoption cycle.
9
10 Changes made to subject matter standards shall be approved by the
10
11 Board and subject to legislative review and approval one (1) year
11
12 prior to the corresponding subject area textbook adoption cycle to
12
13 provide textbook vendors time to adjust textbook materials which
13
14 align to subject matter standards. The Board may determine a review
14
15 of subject matter standards is not necessary if the state textbook
15
16 cycle for a subject area is conducted in less than a six-year cycle.
16
17 If subject matter standards are reviewed fewer than twelve (12)
17
18 years after substantive changes have been made, the Executive
18
19 Committee, in consultation with the Department, may recommend minor
19
20 technical changes to the Board and waive the committee requirements
20
21 outlined in subparagraphs b and c of paragraph 2 of subsection B of
21
22 this section. After review, the State Board shall adopt any
22
23 revisions in such subject matter standards deemed necessary to
23
24 achieve further improvements in the quality of education for the

1 students of this state. Any revisions adopted by the State Board of

2 Education shall be subject to review and approval as provided for in
2
3 Section 4 11-103.6a-1 of this act title. The adoption of subject
3
4 matter standards or revisions to the standards by the State Board of
4
5 Education pursuant to this section shall not be promulgated as rules
5
6 and shall not be subject to Article I of the Administrative
6
7 Procedures Act.
7
8 B. 1. In addition to the requirements set forth in subsection
8
9 A of this section, on or before August 1, 2016, the The State Board
9
10 of Education, in consultation with the Oklahoma State Regents for
10
11 Higher Education, and the State Board of Career and Technology
11
12 Education and the Oklahoma Department of Commerce, shall adopt
12
13 ensure all subject matter standards for English Language Arts and
13
14 Mathematics which are college- and career-ready and will replace
14
15 current standards. To be considered college- and career-ready, the
15
16 standards shall be evaluated by the State Department of Education,
16
17 the State Regents for Higher Education, the State Board of Career
17
18 and Technology Education and the Oklahoma Department of Commerce and
18
19 be determined to be such that the standards will address the goals
19
20 of reducing the need for remedial coursework at the postsecondary
20
21 level and increasing successful completion of postsecondary
21
22 education. The subject matter standards and corresponding student
22
23 assessments for English Language Arts and Mathematics shall be
23
24 solely approved and controlled by the state through the State Board

1 of Education through a review and revision process as provided in

2 this section.

3 2. Upon the effective date of this act, the State Board of
3
4 Education shall begin the process of adopting the English Language
4
5 Arts and Mathematics standards and shall provide reasonable
5
6 opportunity, review subject matter standards consistent with best
6
7 practices, for public comment on the revision of the standards,
7
8 including but not limited to comments from students, parents,
8
9 educators, organizations representing students with disabilities and
9
10 English language learners, higher education representatives, career
10
11 technology education representatives, subject matter experts,
11
12 community-based organizations, Native American tribal
12
13 representatives and business community representatives and inclusive
13
14 of a variety of stakeholders across the state with expertise in the
14
15 subject area standards under review. Each standards review process
15
16 shall leverage three (3) committees and include a public comment
16
17 period to support the review and possible revision of subject matter
17
18 standards under review by the State Board of Education:
18
19 a. an Executive Committee consisting of five (5) to eight
19
20 (8) members shall be established for each subject
20
21 matter under review by the State Board of Education.
21
22 Executive Committee members shall be selected to
22
23 ensure representation from a variety of
23
24 characteristics, including geography, grade level

1 expertise, ethnic and cultural backgrounds, and
1
2 experience in public education. At least one member
2
3 of the Executive Committee shall be a public school
3
4 educator in prekindergarten through twelfth grades and
4
5 at least one member shall be a representative of
5
6 higher education in the state with expertise in the
6
7 subject area standards under review. The Executive
7
8 Committee, in coordination with State Department of
8
9 Education staff, shall guide the subject matter
9
10 standards review process and select stakeholders to
10
11 serve on a Writing Committee and Draft Committee for
11
12 each subject area standards review through an
12
13 application process made available to the public on
13
14 the Department website and other standard forms of
14
15 communication. The Executive Committee, in
15
16 coordination with Department staff, and a Writing
16
17 Committee shall develop a set of criteria for quality
17
18 standards for each subject area standards under
18
19 review. The criteria used to guide the standards
19
20 review process shall be evidence-based and may
20
21 include, but shall not be limited to, the following:
21
22 (1) effective preparation for active citizenship and
22
23 postsecondary education or the workforce,
23
24 (2) subject matter content,

1 (3) sequencing of subject matter content and
1
2 relationship to measurement of student
2
3 performance and the application of subject matter
3
4 standards,
4
5 (4) developmental appropriateness of grade-level
5
6 expectations, academic content, and instructional
6
7 rigor,
7
8 (5) clarity for educators and families,
8
9 (6) measurability of student proficiency in the
9
10 subject matter,
10
11 (7) evidence-based pedagogy,
11
12 (8) development of critical thinking skills, and
12
13 (9) demonstration of application of acquired
13
14 knowledge and skills,
14
15 b. a Writing Committee shall be established for each
15
16 subject area standards review and shall be tasked with
16
17 reviewing and, if necessary, revising the subject
17
18 matter standards utilizing criteria for quality
18
19 subject matter standards established by the Executive
19
20 Committee and Department staff. The Writing Committee
20
21 may recommend modifications to the criteria for
21
22 quality subject matter standards. Members of the
22
23 Writing Committee shall include representatives with
23
24 expertise in the subject matter standards under review

1 from prekindergarten through twelfth grade education,
1
2 higher education, informal education, technology
2
3 center schools, and the community. Members shall be
3
4 selected by the Executive Committee members and
4
5 Department staff through an application process,
5
6 ensuring representation from a variety of
6
7 characteristics, including geography, grade level
7
8 experience, ethnic and cultural backgrounds, and
8
9 experience in public education. Educator expertise
9
10 shall be prioritized in the application selection
10
11 process for Writing Committee members with special
11
12 consideration for inclusion given to educators with
12
13 experience implementing the subject matter standards
13
14 under review, and
14
15 c. a Draft Review Committee shall be established for each
15
16 subject area standards review and shall be responsible
16
17 for reviewing and providing feedback on draft versions
17
18 of subject area standards produced by the Writing
18
19 Committee during each subject matter standards review
19
20 process. Feedback shall be consistent with the
20
21 quality criterion established by the Executive
21
22 Committee, Writing Committee, and Department staff
22
23 provided for in this section. Members of the Draft
23
24 Review Committee shall include representatives from

1 prekindergarten through twelfth grade education,
1
2 higher education, informal education, career
2
3 technology, and the community and are selected by
3
4 Executive Committee members and Department staff
4
5 through an application process, ensuring
5
6 representation from a variety of characteristics,
6
7 including geography, grade level experience, ethnic
7
8 and cultural backgrounds, and experience.
8
9 3. The State Board of Education shall actively seek public
9
10 comments from diverse stakeholders including, but not limited to,
10
11 students, families of public school students, public school
11
12 educators, organizations representing students with disabilities and
12
13 English language learners, higher education representatives, career
13
14 technology education representatives, subject matter experts,
14
15 community-based organizations, Native American tribal
15
16 representatives, and business community representatives for a draft
16
17 version of subject matters standards produced by the Executive
17
18 Committee and Writing Committee. The State Board of Education shall
18
19 provide a public comment period of not less than thirty (30) days
19
20 for subject matter draft standards. Public comments shall be
20
21 reviewed by the Executive Committee and Writing Committee to
21
22 determine if additional modifications to the subject area standards
22
23 are needed.

1 4. Until the statewide student assessments for English Language
1
2 Arts and Mathematics subject matter standards are implemented as
2
3 provided for in paragraph 1 of subsection C of this section
3
4 operational, the State Board of Education shall implement the
4
5 subject matter standards for English Language Arts and Mathematics
5
6 which were in place prior to the revisions adopted by the Board in
6
7 June 2010 review process provided for in this subsection.
7
8 4. Upon the effective date of this act, the State Board of
8
9 Education shall seek certification from the State Regents for Higher
9
10 Education that the subject matter standards for English Language
10
11 Arts and Mathematics which were in place prior to the revisions
11
12 adopted by the Board in June 2010 are college- and career-ready as
12
13 defined in the Federal Elementary and Secondary Education Act (ESEA)
13
14 Flexibility document issued by the United States Department of
14
15 Education and referenced in Option B of Principle 1: College and
15
16 Career-Ready Expectations for All Students. The State Regents shall
16
17 provide the Board a detailed description of the certification
17
18 process and results, including a list of deficiencies if the State
18
19 Regents conclude that the standards are not college- and career-
19
20 ready. The Board shall post all documents, materials, reports,
20
21 descriptions and correspondence produced by the State Regents or
21
22 used by the State Regents in the certification process on the
22
23 website for the State Department of Education.

1 C. 1. On or before the 2017-18 school year, the State Board of
1
2 Education, in consultation with the State Regents for Higher
2
3 Education, the State Board of Career and Technology Education and
3
4 the Oklahoma Department of Commerce, shall direct the process of the
4
5 development of annual high-quality statewide student assessments for
5
6 English Language Arts and Mathematics as provided for in Section
6
7 1210.508 of this title that align with the college- and career-ready
7
8 subject matter standards developed pursuant to subsection B of this
8
9 section.
9
10 2. The statewide student assessments for English Language Arts
10
11 and Mathematics shall continue to assess standards and objectives
11
12 found in the subject matter standards for English Language Arts and
12
13 Mathematics which were in place prior to the revisions adopted by
13
14 the Board in June 2010 and the test blueprints shall continue to
14
15 align to the
