7 An Act relating to Route 66; amending Section 1,
7 Chapter 412, O.S.L. 2022 (69 O.S. Supp. 2023, Section
8 4040), which relates to the Oklahoma Route 66
8 Commission; removing expiration date of the Oklahoma
9 Route 66 Commission; amending Section 2, Chapter 412,
9 O.S.L. 2022 (69 O.S. Supp. 2023, Section 4041), which
10 relates to the Oklahoma Route 66 Commission Revolving
10 Fund; modifying conditions for budgeting and
11 expenditures of funds; and providing an effective
11 date.

16 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

17 SECTION 1. AMENDATORY Section 1, Chapter 412, O.S.L.
17
18 2022 (69 O.S. Supp. 2023, Section 4040), is amended to read as
18
19 follows:
19
20 Section 4040. A. There is hereby created until June 30, 2027,
20
21 the Oklahoma Route 66 Commission. The Commission shall be composed
21
22 of nine (9) members. The members shall serve as follows:
22
23 1. One member shall be appointed by the Governor and selected
23
24 from the Commissioners of the Oklahoma Tax Commission, whose first

1 term shall be for one (1) year, and then renewable for three-year
1
2 terms thereafter;

3 2. One shall be the Executive Director of the Oklahoma
3
4 Department of Transportation, or his or her designee, whose first
4
5 term shall be for two (2) years, and then renewable for three-year
5
6 terms thereafter;

7 3. One shall be the Executive Director of the Oklahoma Tourism
7
8 and Recreation Department, or his or her designee, whose first term
8
9 shall be for three (3) years, and then renewable for three-year
9
10 terms thereafter;

11 4. Three members shall be appointed by the President Pro
11
12 Tempore of the Oklahoma State Senate of which:
12
13 a. one shall be a citizen of a county containing a
13
14 portion of Route 66, whose first term shall be for one
14
15 (1) year, and renewable for three-year terms
15
16 thereafter,
16
17 b. one shall be a city manager, assistant city manager,
17
18 or economic development director for a municipality on
18
19 Route 66 with a population greater than ten thousand
19
20 (10,000), whose first term shall be for two (2) years,
20
21 and renewable for three-year terms thereafter, and
21
22 c. one shall be an Oklahoma citizen with expertise or
22
23 experience in historic preservation, whose first term
23

1 shall be for three (3) years, and then renewable for

2 three-year terms thereafter; and

3 5. Three members shall be appointed by the Speaker of the
3
4 Oklahoma House of Representatives of which:
4
5 a. one shall be a citizen of a county containing a
5
6 portion of Route 66, whose first term shall be for one
6
7 (1) year, and then renewable for three-year terms
7
8 thereafter,
8
9 b. one of whom shall be a business owner whose business
9
10 is located along Route 66 within a city or town whose
10
11 population is less than ten thousand (10,000), whose
11
12 first term shall be for two (2) years, and then
12
13 renewable for three-year terms thereafter, and
13
14 c. one shall be an Oklahoma citizen with expertise or
14
15 experience in marketing, whose first term shall be for
15
16 three (3) years, and then renewable for three-year
16
17 terms thereafter.

18 B. The Commission shall utilize the Oklahoma Route 66
18
19 Commission Revolving Fund as authorized in Section 2 of this act.
19
20 SECTION 2. AMENDATORY Section 2, Chapter 412, O.S.L.
20
21 2022 (69 O.S. Supp. 2023, Section 4041), is amended to read as
21
22 follows:
22
23 Section 4041. A. There is hereby created in the State Treasury
23
24 a revolving fund to be designated as the "Oklahoma Route 66
24

1 Commission Revolving Fund", which shall consist of all monies
1
2 appropriated, transferred, or otherwise designated to the fund by
2
3 law. The revolving fund shall be a continuing fund, not subject to
3
4 fiscal year limitations, and shall be under the administration of
4
5 the Oklahoma Route 66 Commission. All monies accruing to the credit
5
6 of said fund are hereby appropriated, and shall be budgeted and
6
7 expended in accordance with the provisions of subsection B of this
7
8 section for the purpose of preserving and developing Route 66 and
8
9 commemorating the Route 66 Centennial.

10 B. No funds shall be budgeted or expended from the Oklahoma
10
11 Route 66 Commission Revolving Fund prior to July 1, 2023, or prior
11
12 to the approval adoption by the Legislature Commission of proposed
12
13 promulgated permanent rules by the Commission pursuant to the
13
14 provisions of the Administrative Procedures Act.
14
15 C. The Oklahoma Route 66 Commission shall promulgate, pursuant
15
16 to the provisions of the Administrative Procedures Act, permanent
16
17 rules subject to approval by the Legislature, to implement:
17
18 1. Application procedures for projects submitting requests for
18
19 funds;
19
20 2. Processes for awarding of funding applications;
20
21 3. Details of the Commission's general duties;
21
22 4. Reporting requirements of the Commission to the Legislature;

1 5. Any other rules necessary to carry out the purpose and

2 mission of the Commission as expressed in this act.

3 D. All unencumbered funds remaining in the Oklahoma Route 66
3
4 Commission Revolving Fund upon the expiration of the Oklahoma Route
4
5 66 Commission shall be transferred to the State Treasurer for
5
6 deposit in the General Revenue Fund.

7 SECTION 3. This act shall become effective November 1, 2024.
