7 Employment and Education Outcomes for Homeless Youth
8 Act; authorizing certain individuals to verify
8 whether certain children and youth are homeless;
9 providing procedural requirements; providing
9 specifics for written verification; amending 47 O.S.
10 2021, Section 6-105.3, as last amended by Section 6,
10 Chapter 47, 1st Extraordinary Session, O.S.L. 2023
11 (47 O.S. Supp. 2023, Section 6-105.3), which relates
11 to identification cards; providing exception to age
12 requirement; providing exception to fee charge;
12 providing for noncodification; providing for
13 codification; and providing an effective date.

16 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
16
17 SECTION 1. NEW LAW A new section of law not to be
17
18 codified in the Oklahoma Statutes reads as follows:
18
19 This act shall be known and may be cited as the "Improving
19
20 Employment and Education Outcomes for Homeless Youth Act".
20
21 SECTION 2. NEW LAW A new section of law to be codified
21
22 in the Oklahoma Statutes as Section 601.6d of Title 10, unless there
22
23 is created a duplication in numbering, reads as follows:

1 A. Persons who are believed to be homeless children and youth
1
2 as defined in Section 600 of Title 10 of the Oklahoma Statutes may
2
3 be verified as being homeless by:
3
4 1. The director or designee of a homeless shelter;
4
5 2. The director or designee of a transitional living program;
5
6 3. The McKinney-Vento homeless liaison of a public school; or
6
7 4. A continuum of care lead agency or its designee.
7
8 B. Verification that a child or youth is homeless shall
8
9 consist, at a minimum, of the following steps:
9
10 1. The child or youth shall be known to the person verifying
10
11 his or her housing status;
11
12 2. If verifying the status of a child or youth under eighteen
12
13 (18) years of age, the person verifying shall:
13
14 a. check the National Missing and Unidentified Persons
14
15 System (NamUs) referenced in Section 151.3 of Title 74
15
16 of the Oklahoma Statutes for the name of the child or
16
17 youth,
17
18 b. send a letter by return receipt mail to the last known
18
19 address of the parent or legal guardian of the child
19
20 or youth informing the parent or legal guardian that
20
21 the person verifying is assisting the child or youth
21
22 in obtaining a REAL ID noncompliant identification
22
23 card, and
23

1 c. if no response from the parent or legal guardian

2 objecting to the child or youth obtaining a REAL ID
2
3 noncompliant identification card is received within
3
4 fifteen (15) business days, the person may prepare
4
5 written verification stating that the child or youth
5
6 is homeless.
6
7 The written verification shall be printed on the letterhead of
7
8 the entity authorized to verify the housing status of the child or
8
9 youth and shall be dated, signed by the person verifying, and
9
10 notarized.
10
11 SECTION 3. AMENDATORY 47 O.S. 2021, Section 6-105.3, as
11
12 last amended by Section 6, Chapter 47, 1st Extraordinary Session,
12
13 O.S.L. 2023 (47 O.S. Supp. 2023, Section 6-105.3), is amended to
13
14 read as follows:
14
15 Section 6-105.3 A. In addition to the licenses to operate
15
16 motor vehicles, the Department of Public Safety may issue cards to
16
17 Oklahoma residents for purposes of identification only. The
17
18 identification cards shall be issued, renewed, replaced, canceled
18
19 and denied in the same manner as driver licenses in this state. A
19
20 licensee whose record reflects a notation of the person's proof of
20
21 legal presence, verified by the U.S. Department of Homeland
21
22 Security, or proof of U.S. citizenship, may obtain a REAL ID
22
23 Compliant Identification Card or a Noncompliant Identification Card
23
24 from a motor license agent or the Department of Public Safety,

1 regardless of the status of the license held by the licensee.

2 Provided, the licensee must comply with all REAL ID documentation
2
3 requirements to obtain a REAL ID Compliant Identification Card. A
3
4 person shall not apply for or possess more than one state-issued or
4
5 territory-issued REAL ID Compliant Identification Card pursuant to
5
6 the provisions of Section 6-101 of this title.
6
7 The application for an identification card by any person under
7
8 the age of eighteen (18) years shall be signed and verified by a
8
9 custodial legal parent or legal guardian, either in person before a
9
10 person authorized to administer oaths or electronically if
10
11 completing an online application, or a notarized affidavit signed by
11
12 a custodial legal parent or legal guardian submitted before a person
12
13 authorized to administer oaths by the person under the age of
13
14 eighteen (18) years with the application. Provided, that persons
14
15 under eighteen (18) years of age who are homeless children and
15
16 youth, as defined in Section 600 of Title 10 of the Oklahoma
16
17 Statutes and verified as such through the process established in
17
18 Section 1 of this act, shall be allowed to apply for a REAL ID
18
19 Noncompliant Identification Card without the signature of their
19
20 parent or legal guardian. Except as otherwise provided in this
20
21 section, the identification cards shall be valid for a period of
21
22 either four (4) years from the month of issuance or eight (8) years
22
23 from the month of issuance; however, the identification cards issued
23

1 to persons sixty-five (65) years of age or older shall be valid

2 indefinitely from the month of issuance.
2
3 B. 1. The Department of Corrections shall coordinate with the
3
4 Department of Public Safety to provide REAL ID Noncompliant
4
5 Identification Cards to all inmates who do not have a current state-
5
6 issued identification card or driver license upon their release from
6
7 custody. The identification cards shall be issued, replaced,
7
8 canceled and denied in the same manner as driver licenses in this
8
9 state.
9
10 2. The Department of Public Safety shall allow the use of a
10
11 certified copy of a birth certificate coupled with a Department of
11
12 Corrections-issued consolidated record card to serve as a valid form
12
13 of photo identification documentation to obtain a REAL ID
13
14 Noncompliant Identification Card.
14
15 3. REAL ID Noncompliant Identification Cards issued with a
15
16 consolidated record card from the Department of Corrections for
16
17 inmates shall be valid for a period of four (4) years from the month
17
18 of issuance for an allowable fee to be determined by the Department
18
19 of Public Safety and are nonrenewable and nontransferable.
19
20 4. The fee charged for the issuance or replacement of a REAL ID
20
21 Noncompliant Identification Card pursuant to this subsection shall
21
22 be deposited in the Department of Public Safety Revolving Fund.
22
23 Provided, however, REAL ID Noncompliant Identification Cards issued
23
24 to individuals required to register pursuant to the Sex Offenders

1 Registration Act shall only be valid for a period of one (1) year.
1
2 No person sixty-five (65) years of age or older shall be charged a
2
3 fee for a REAL ID Noncompliant Identification Card.
3
4 5. The Department of Public Safety is authorized to promulgate
4
5 rules and procedures to implement the provisions of this subsection.
5
6 C. No person shall hold more than one state-issued or
6
7 territory-issued REAL ID Compliant Driver License or REAL ID
7
8 Compliant Identification Card, as defined in subsection G of Section
8
9 6-101 of this title. The Department shall not issue a REAL ID
9
10 Compliant Identification Card to any applicant who has been
10
11 previously issued a REAL ID Compliant Driver License or REAL ID
11
12 Compliant Identification Card unless such license or identification
12
13 card has been surrendered to the Department by the applicant. The
13
14 Department may promulgate rules related to the issuance of
14
15 replacement REAL ID Compliant Identification Cards in the event of
15
16 loss or theft.
16
17 D. The fee charged for the issuance or renewal of a REAL ID
17
18 Compliant Identification Card shall be Twenty-five Dollars ($25.00)
18
19 for a 4-year card and Fifty Dollars ($50.00) for an 8-year card.
19
20 The fee charged for the issuance or renewal of a REAL ID
20
21 Noncompliant Identification Card pursuant to this section shall be
21
22 Twenty-five Dollars ($25.00) for a 4-year card and Fifty Dollars
22
23 ($50.00) for an 8-year card; however, no person sixty-five (65)
23
24 years of age or older, or one hundred percent (100%) disabled

1 veteran described in subsection P of Section 6-101 of this title, or
1
2 persons who are homeless children and youth as defined in Section
2
3 600 of Title 10 of the Oklahoma Statutes and verified through the
3
4 process established in Section 1 of this act shall be charged a fee
4
5 for an identification card. Of each fee charged pursuant to the
5
6 provisions of this subsection:
6
7 1. Seven Dollars ($7.00) of a 4-year card and Fourteen Dollars
7
8 ($14.00) of an 8-year card shall be apportioned as provided in
8
9 Section 1104 of this title;
9
10 2. Three Dollars ($3.00) of a 4-year card and Six Dollars
10
11 ($6.00) of an 8-year card shall be credited to the Department of
11
12 Public Safety Computer Imaging System Revolving Fund to be used
12
13 solely for the purpose of the administration and maintenance of the
13
14 computerized imaging system of the Department;
14
15 3. Ten Dollars ($10.00) of a 4-year card and Twenty Dollars
15
16 ($20.00) of an 8-year card shall be deposited in the Department of
16
17 Public Safety Revolving Fund;
17
18 4. Three Dollars ($3.00) of a 4-year card and Six Dollars
18
19 ($6.00) of an 8-year card shall be deposited to the State Public
19
20 Safety Fund created in Section 2-147 of this title; and
20
21 5. Two Dollars ($2.00) for a 4-year card and Four Dollars
21
22 ($4.00) for an 8-year card of the fee authorized by this subsection
22
23 related to the issuance or renewal of an identification card by a
23
24 motor license agent that does process approved applications or

1 renewals for REAL ID Compliant and REAL ID Non-Compliant Driver
1
2 Licenses or Identification Cards shall be retained by the licensed
2
3 operator through June 30, 2023. Beginning July 1, 2023, these
3
4 monies shall be retained by the licensed operator pursuant to
4
5 subsection E of Section 1141.1 of this title.
5
6 E. The fee charged for replacement of a REAL ID Compliant
6
7 Identification Card, or REAL ID Non-Compliant Identification Card,
7
8 shall be Twenty-five Dollars ($25.00); however, no person sixty-five
8
9 (65) years of age or older shall be charged a fee for an
9
10 identification card replacement. Of each fee charged pursuant to
10
11 the provisions of this subsection:
11
12 1. Seven Dollars ($7.00) shall be apportioned as provided in
12
13 Section 1104 of this title;
13
14 2. Three Dollars ($3.00) shall be credited to the Department of
14
15 Public Safety Computer Imaging System Revolving Fund to be used
15
16 solely for the purpose of the administration and maintenance of the

18 3. Ten Dollars ($10.00) shall be deposited in the Department of
18
19 Public Safety Revolving Fund;

20 4. Three Dollars ($3.00) shall be deposited to the State Public
20
21 Safety Fund created in Section 2-147 of this title; and
21
22 5. Two Dollars ($2.00) of the fee authorized by this subsection
22
23 related to the replacement of an identification card by a motor
23
24 license agent that does process approved applications or renewals

1 for REAL ID Compliant or REAL ID Non-Compliant Driver Licenses or
1
2 Identification Cards shall be retained by the licensed operator
2
3 through June 30, 2023. Beginning July 1, 2023, these monies shall
3
4 be retained by the licensed operator pursuant to subsection E of
4
5 Section 1141.1 of this title.
5
6 F. The Oklahoma Tax Commission is hereby authorized to
6
7 reimburse, from funds available to that agency, each motor license
7
8 agent issuing an identification card to a person sixty-five (65)
8
9 years of age or older, an amount not to exceed One Dollar ($1.00)
9
10 for each card or driver license so issued through June 30, 2023.
10
11 The Tax Commission shall develop procedures for claims for
11
12 reimbursement.
12
13 G. Notwithstanding any other provision of law, when a person
13
14 makes application for a new identification card, or makes
14
15 application to renew an identification card, and the person has been
15
16 convicted of, or received a deferred judgment for, any offense
16
17 required to register pursuant to the Sex Offenders Registration Act,
17
18 the identification card shall be valid for a period of one (1) year
18
19 from the month of issuance, but may be renewed yearly during the
19
20 time the person is subject to registration on the Sex Offender
20
21 Registry. The cost for such identification card shall be the same
21
22 as for other identification cards and renewals.

23 H. Nothing in this section requires or authorizes the
23
24 Department of Public Safety to issue a REAL ID Noncompliant

1 Identification Card without the documentation required by the
1
2 provisions of paragraph 9 of subsection A of Section 6-103 of this
2
3 title.
3
4 SECTION 4. This act shall become effective November 1, 2024.
