7 An Act relating to medical marijuana; directing
7 licensed medical marijuana processors and licensed
8 medical marijuana commercial growers to sell certain
8 medical marijuana products in pre-packaged form;
9 providing requirements for packaging; allowing for
9 the display and smelling of marijuana; providing for
10 codification; and providing an effective date.

13 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

14 SECTION 1. NEW LAW A new section of law to be codified
14
15 in the Oklahoma Statutes as Section 431.1 of Title 63, unless there
15
16 is created a duplication in numbering, reads as follows:

17 A. Upon the effective date of this act, all medical marijuana
17
18 flower, trim, shake, kief, product, or other flower-based product
18
19 not defined as a concentrate, shall be sold by licensed medical
19
20 marijuana processors and licensed medical marijuana commercial
20
21 growers to licensed medical marijuana dispensaries only in pre-
21
22 packaged form in package sizes weighing not less than one-half (1/2)
22
23 of one (1) gram to not more than three (3) ounces.

1 B. Nonopaque materials may be used when packaging medical

2 marijuana flower provided all other packaging and labeling
2
3 requirements for medical marijuana products sold in this state are
3
4 met and it is placed in an opaque container before leaving a
4
5 licensed medical marijuana dispensary.
5
6 C. The display and smelling of medical marijuana shall be
6
7 allowed pursuant to Section 421 of Title 63 of the Oklahoma
7
8 Statutes.

9 SECTION 2. This act shall become effective November 1, 2024.
