7 An Act relating to the Office of Juvenile Affairs;
7 amending 62 O.S. 2021, Sections 155, as amended by
8 Section 34, Chapter 29, O.S.L. 2023, and 203 (62 O.S.
8 Supp. 2023, Section 155), which relate to public
9 finance; removing language relating to the Santa
9 Clause Commission; repealing 10 O.S. 2021, Sections
10 361, 362, and 363, which relate to the Santa Clause
10 Commission; and providing an effective date.

13 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

14 SECTION 1. AMENDATORY 62 O.S. 2021, Section 155, as
14
15 amended by Section 34, Chapter 29, O.S.L. 2023 (62 O.S. Supp. 2023,
15
16 Section 155), is amended to read as follows:
16
17 Section 155. A. There is hereby created in the State Treasury
17
18 a revolving fund for each of the following state boards,
18
19 commissions, and departments:
19
20 1. The Board of Governors of the Licensed Architects, Landscape
20
21 Architects and Registered Commercial Interior Designers of Oklahoma;
21
22 2. Oklahoma Funeral Board;
22
23 3. Board of Podiatric Medical Examiners;
23
24 4. Board of Chiropractic Examiners;

1 5. State Board of Medical Licensure and Supervision;

2 6. Oklahoma Board of Nursing;

3 7. State Board of Osteopathic Examiners;
3
4 8. State Board of Pharmacy;
4
5 9. State Board of Licensed Social Workers;

6 10. Oklahoma New Motor Vehicle Commission; and
6
7 11. Oklahoma Real Estate Commission; and
7
8 12. Santa Claus Commission.

9 B. Each revolving fund shall consist of all monies received by
9
10 the boards, commissions, and departments, pursuant to statutory
10
11 authority, but not including appropriated funds. These revolving
11
12 funds shall be continuing funds, not subject to fiscal year
12
13 limitations, and shall be under the control and management of the
13
14 administrative authorities of the respective boards, commissions, or
14
15 departments.

16 C. Expenditures from the revolving funds shall be made pursuant
16
17 to the laws of the state and the statutes relating to the boards,
17
18 commissions, and departments, and without legislative appropriation.
18
19 Warrants for expenditures from the revolving funds shall be drawn by
19
20 the State Treasurer, based on claims signed by an authorized
20
21 employee or employees of the respective boards, commissions, or
21
22 departments and approved for payment by the Director of the Office
22
23 of Management and Enterprise Services.

1 SECTION 2. AMENDATORY 62 O.S. 2021, Section 203, is

2 amended to read as follows:

3 Section 203. A. Except as otherwise provided by subsection B
3
4 of this section, all monies that may come into the State Treasury,
4
5 pursuant to the provisions of Section 201 et seq. of this title,
5
6 together with all amounts that may be received by the State
6
7 Treasurer as investment income or as interest on average daily bank
7
8 balances, including investment income or interest on deposits from
8
9 funds deposited to the credit of the Constitutional Reserve Fund
9
10 created pursuant to Section 23 of Article X of the Oklahoma
10
11 Constitution, shall be apportioned and credited to the General
11
12 Revenue Fund for the current year.
12
13 B. The provisions of subsection A of this section shall not
13
14 apply to:
14
15 1. Interest received on deposits from funds under the control
15
16 of the Commissioners of the Land Office;
16
17 2. Funds in the Department of Human Services Federal
17
18 Disallowance Fund;
18
19 3. Interest received on deposits from funds under the control
19
20 of the Santa Claus Commission;
20
21 4. The Risk Management Revolving Fund;
21
22 5. 4. Investment income and interest received from funds in the
22
23 Quartz Mountain Revolving Fund from insurance claims;

1 6. 5. The Drinking Water Treatment Revolving Loan Account and
1
2 the Drinking Water Treatment Loan Administrative Fund;
2
3 7. 6. The Clean Water State Revolving Fund Loan Account and the
3
4 Clean Water State Revolving Fund Loan Administrative Fund;
4
5 8. 7. The State Infrastructure Bank Revolving Fund;
5
6 9. 8. The Nursing Facility Quality of Care Fund;
6
7 10. 9. The Oklahoma Tourism and Recreation Department Revolving
7
8 Fund effective July 1, 2003;
8
9 11. 10. The Golf Course Operations Revolving Fund effective
9
10 July 1, 2003; and
10
11 12. 11. Interest received on investments from funds in the
11
12 County Bridge and Road Improvement Fund, the Emergency and
12
13 Transportation Revolving Fund, the County Road Machinery and
13
14 Equipment Revolving Fund, the High Priority State Bridge Revolving
14
15 Fund as created in Section 506 of Title 69 of the Oklahoma Statutes,
15
16 and the County Improvements for Roads and Bridges Fund as created in
16
17 Section 507 of Title 69 of the Oklahoma Statutes.
17
18 SECTION 3. REPEALER 10 O.S. 2021, Sections 361, 362, and
18
19 363, are hereby repealed.
19
20 SECTION 4. This act shall become effective November 1, 2024.
