7 An Act relating to health benefit plans; defining
7 terms; requiring reimbursement of certain
8 prescription; construing provisions; providing for
8 codification; and providing an effective date.

11 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

12 SECTION 1. NEW LAW A new section of law to be codified
12
13 in the Oklahoma Statutes as Section 6060.3b of Title 36, unless
13
14 there is created a duplication in numbering, reads as follows:

15 A. As used in this section:

16 1. “Contraceptive drugs” means all drugs approved by the United
16
17 States Food and Drug Administration that are used to prevent
17
18 pregnancy, including, but not limited to, hormonal drugs
18
19 administered orally, transdermally, and intravaginally; and

20 2. “Health benefit plan” means a health benefit plan as defined
20
21 pursuant to Section 6060.4 of Title 36 of the Oklahoma Statutes.

22 B. 1. Any health benefit plan that is offered, issued, or
22
23 renewed on and after the effective date of this act that offers
23
24 coverage for contraceptive drugs shall provide reimbursement for a

1 twelve-month prescription of contraceptive drugs obtained at one

2 time by the enrollee.

3 2. Nothing in this section shall be construed to prohibit an
3
4 enrollee of a health benefit plan from requesting a smaller supply
4
5 or to prohibit a prescribing provider from prescribing a smaller
5
6 supply if such a prescription is supported by clinical utility and
6
7 medical appropriateness.

8 SECTION 2. This act shall become effective November 1, 2024.
