7 An Act relating to crimes and punishments; creating a
7 felony for the dissemination and publication of
8 certain digitization; creating a misdemeanor for
8 failure to make certain disclosures; defining terms;
9 providing for codification; providing an effective
9 date; and declaring an emergency.

12 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

13 SECTION 1. NEW LAW A new section of law to be codified
13
14 in the Oklahoma Statutes as Section 1630 of Title 21, unless there
14
15 is created a duplication in numbering, reads as follows:

16 A. A person who disseminates or publishes a digitization
16
17 depicting another person's name, image, or likeness without their
17
18 written consent and with the intent to cause emotional, financial,
18
19 or physical harm shall be guilty of a felony.
19
20 B. Any digitization shall include a disclosure that the image
20
21 is a digitization. Failure to disclose shall result in a
21
22 misdemeanor.

23 C. For purposes of this act:

 1 1. The term "digitization" shall mean a still or video image
1
2 that is altered to appear in a realistic manner utilizing an image
2
3 or images of a person other than the person depicted or computer-
3
4 generated images.

5 2. The term "disseminate" means to give, provide, lend, deliver,
5
6 mail, send, forward, transfer, or transmit, electronically or
6
7 otherwise, to another person.

8 3. The term "publish" means:
8
9 a. to disseminate with the intent that such images be
9
10 sold by another person, or
10
11 b. to post, present, display, exhibit, circulate,
11
12 advertise, or allow access to, electronically or
12
13 otherwise, so as to make an image or images available
13
14 to the public.

15 SECTION 2. This act shall become effective July 1, 2024.
15
16 SECTION 3. It being immediately necessary for the preservation
16
17 of the public peace, health or safety, an emergency is hereby
17
18 declared to exist, by reason whereof this act shall take effect and
18
19 be in full force from and after its passage and approval.
