7 An Act relating to hospitals; creating the Heart
7 Attack System of Care Act; requiring the State
8 Department of Health to designate certain hospitals;
8 providing certain criteria for designation; providing
9 certain requirements for application; mandating
9 dissemination of certain hospital list to emergency
10 medical services; requiring certain training for
10 emergency medical services; providing for
11 noncodification; providing for codification; and
11 providing an effective date.

14 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

15 SECTION 1. NEW LAW A new section of law not to be
15
16 codified in the Oklahoma Statutes reads as follows:
16
17 This act shall be known and may be cited as the "Heart Attack
17
18 System of Care Act".
18
19 SECTION 2. NEW LAW A new section of law to be codified
19
20 in the Oklahoma Statutes as Section 1-726.1 of Title 63, unless
20
21 there is created a duplication in numbering, reads as follows:
21
22 A. The State Department of Health shall recognize hospitals
22
23 that meet the criteria set forth in this act and shall be designated
23
24 as one of the following:

1 1. Level 1 Heart Attack Center defined as a hospital that has
1
2 received certification by a nationally recognized certifying
2
3 organization, such as the American Heart Association or the Joint
3
4 Commission Comprehensive Heart Attack Center Certification, or
4
5 American College of Cardiology (ACC) Chest Pain Center with primary
5
6 percutaneous coronary intervention (PCI)and resuscitation;

7 2. Level 2 Heart Attack Center defined as a hospital that
7
8 received certification by a nationally recognized certifying
8
9 organization, such as the American Heart Association or the Joint
9
10 Commission Primary Heart Attack Center or the American College of
10
11 Cardiology (ACC) Chest Pain Center with PCI ; or
11
12 3. Level 3 Heart Attack Center defined as a hospital that has
12
13 received certification by a nationally recognized certifying
13
14 organization, such as the American Heart Association or the Joint
14
15 Commission Acute Heart Attack Ready Center or the American College
15
16 of Cardiology (ACC) Chest Pain Center.
16
17 B. A hospital shall apply to the Department for recognition of
17
18 such designation and shall demonstrate to the satisfaction of the
18
19 Department that the hospital meets the applicable criteria set forth
19
20 in this act.
20
21 C. Self-designation by any health care facility is not
21
22 considered a recognized indicator of certification and shall not be
22
23 recognized by the state.

1 D. The Department shall not limit the number of hospitals

2 seeking recognition of such designation as set forth in this act.
2
3 E. The Department shall verify, track, and monitor that the
3
4 hospital maintains its certification as one of the above centers
4
5 with the:
5
6 1. American Heart Association;
6
7 2. The Joint Commission – a not-for-profit organization that
7
8 sets quality standards, conducts on-site evaluations, and delivers
8
9 an interactive educative experience designed to provide solutions
9
10 and resources to support continuous improvement across all health
10
11 care settings; and
11
12 3. the ACC or another Department-approved, nationally
12
13 recognized guidelines-based certifying or accrediting body for
13
14 health care organizations.

15 F. The Department may suspend or revoke a hospital's
15
16 designation if the Department determines that the hospital is not in
16
17 compliance with the requirements of this act.

18 G. At least annually, the Department shall send the list of
18
19 American Heart Association and the Joint Commission centers
19
20 accreditations to the medical director of each licensed emergency
20
21 medical services (EMS) provider in this state. The Department shall
21
22 maintain a copy of the list in the office designated with the
22
23 Department to oversee emergency medical services and shall post a

1 list of approved and verified centers that are designated to receive
1
2 and treat acute coronary syndrome (ACS) and cardiac arrest patients.

3 H. All EMS authorities across the state shall establish pre-
3
4 hospital care protocols related to the assessment, treatment,
4
5 transport, and routing of ACS patients by EMS providers in this
5
6 state. Routing protocols for triage and transport of ACS patients
6
7 should include the distance to the nearest PCI-capable center
7
8 designated to receive and treat ACS patients or other time-sensitive
8
9 cardiac patients.

10 I. All EMS authorities across the state shall establish, as
10
11 part of current training requirements, protocols to assure that
11
12 licensed EMS providers and 9-1-1 dispatch personnel receive training
12
13 on the assessment, triage, and treatment of ACS patients. Training
13
14 shall include the use of an ACS screening instrument, including, but
14
15 not limited to, an electrocardiogram and other cardiac life-saving
15
16 equipment.

17 J. Each EMS provider must comply with all sections of this act.
17
18 K. In no way shall this act be construed to require disclosure
18
19 of any confidential information or other data in violation of the
19
20 Federal Health Insurance Portability and Accountability Act of 1996.
20
21 SECTION 3. This act shall become effective November 1, 2024.
