7 An Act relating to county elective offices; amending
7 26 O.S. 2021, Section 12-111, which relates to
8 vacancies in county elective offices; prohibiting
8 special election for certain vacancies; updating
9 statutory reference; and providing an effective date.

12 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

13 SECTION 1. AMENDATORY 26 O.S. 2021, Section 12-111, is
13
14 amended to read as follows:
14
15 Section 12-111. A. Whenever a vacancy shall occur in the
15
16 office of a county commissioner, the vacancy shall be filled at a
16
17 special election to be called by the Governor within thirty (30)
17
18 days after the vacancy occurs. Provided, no special election shall
18
19 be called if the vacancy occurs in an even-numbered year if the term
19
20 of the office expires is scheduled to appear on the ballot the same
20
21 year, or if the vacancy occurs on or after December 1 of an odd-
21
22 numbered year if the office is scheduled to appear on the ballot the
22
23 following year. In such case, the candidate elected to the office
23
24 at the Primary Election, runoff Primary Election, or the regular

1 General Election shall be appointed by the Governor as soon as

2 practical after the applicable election to fill the unexpired term.

4 of any county in this state having a population of more than the
4
5 population figure specified in subsection B E of Section 10 of Title
5
6 51 of the Oklahoma Statutes, the vacancy shall be filled at a
6
7 special election to be called by the Governor within thirty (30)
7
8 days after the vacancy occurs. Provided, no special election shall
8
9 be called if the vacancy occurs in an even-numbered year if the term
9
10 of the office expires is scheduled to appear on the ballot the same
10
11 year, or if the vacancy occurs on or after December 1 of an odd-
11
12 numbered year if the office is scheduled to appear on the ballot the
12
13 following year. In such case, the candidate elected to the office
13
14 at the Primary Election, runoff Primary Election, or the regular
14
15 General Election shall be appointed by the Governor as soon as

17 SECTION 2. This act shall become effective November 1, 2024.
