7 An Act relating to state highways; amending 69 O.S.
7 2021, Section 1501, which relates to the State
8 Highway Construction and Maintenance Fund; allowing
8 certain monies to be transferred from fund; updating
9 statutory language; updating statutory references;
9 providing an effective date; and declaring an
10 emergency.

12 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

13 SECTION 1. AMENDATORY 69 O.S. 2021, Section 1501, is
13
14 amended to read as follows:
14
15 Section 1501. (a) A. All monies received by taxation or
15
16 otherwise for use on the state highways of this state shall, unless
16
17 otherwise provided by law, be placed in the State Treasury in a fund
17
18 to be known as the State Highway Construction and Maintenance Fund
18
19 “State Highway Construction and Maintenance Fund”. The fund shall
19
20 also consist of revenues specifically apportioned to such fund by
20
21 provisions of the Oklahoma Statutes.

22 (b) B. All monies remaining in the State Highway Construction
22
23 and Maintenance Fund created by 69 O.S. 1961, Section 44(d), when
23
24 this the Oklahoma Highway Code of 1968 becomes effective, and all

1 other assets thereof, and all taxes, revenue and other funds payable

2 to or required to be deposited in such fund under the provisions of
2
3 other laws when this the Oklahoma Highway Code of 1968 becomes
3
4 effective, shall be transferred to, be deposited in and be a part of
4
5 the State Highway Construction and Maintenance Fund created by this
5
6 section; and the latter fund shall be liable for the payment of all
6
7 outstanding obligations existing against the former fund.

8 (c) C. Of the monies deposited in the State Highway
8
9 Construction and Maintenance Fund pursuant to the apportionment of
9
10 Motor Fuels Tax Fees provided in Section 1 of this act 1132.7 of
10
11 Title 47 of the Oklahoma Statutes, the lesser of Ten Thousand
11
12 Dollars ($10,000.00) and one and one-half percent (1 1/2%) of such
12
13 monies may be used for the development and maintenance of
13
14 alternative fuel corridors as defined by the Federal Highway
14
15 Administration.

16 D. Of monies appropriated for each fiscal year and transferred
16
17 into such fund, the Department of Transportation shall be authorized
17
18 to transfer Six Million Nine Hundred Thousand Dollars
18
19 ($6,900,000.00) to the Public Transit Revolving Fund for uses that
19
20 are in accordance with Section 4033 of this title.

21 SECTION 2. This act shall become effective July 1, 2024.

22 SECTION 3. It being immediately necessary for the preservation
22
23 of the public peace, health or safety, an emergency is hereby
23

1 declared to exist, by reason whereof this act shall take effect and

2 be in full force from and after its passage and approval.
