7 An Act relating to firearms; disallowing regulation
7 for certain firearm suppressor; providing for
8 qualifications; requiring certain descriptor;
8 defining terms; providing for codification; and
9 providing an effective date.

12 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

13 SECTION 1. NEW LAW A new section of law to be codified
13
14 in the Oklahoma Statutes as Section 1289.31 of Title 21, unless
14
15 there is created a duplication in numbering, reads as follows:

16 A. 1. A firearm suppressor that is manufactured in this state
16
17 and remains in this state shall not be subject to federal law or
17
18 federal regulation including registration under the authority of the
18
19 United States Congress to regulate interstate commerce.
19
20 2. A basic material from which a firearm suppressor is
20
21 manufactured in this state including unmachined steel, is not a
21
22 firearm suppressor and is not subject to federal regulation under
22
23 the authority of the United States Congress to regulate interstate
23
24 commerce as if it were a firearm suppressor.

1 3. A firearm suppressor manufactured and sold in this state

2 must have the words “Made in Oklahoma” clearly stamped, machined, or
2
3 engraved on it.

4 B. For purposes of this section, a firearm suppressor is
4
5 manufactured in this state if the item is manufactured:
5
6 1. In this state from basic materials; and
6
7 2. Without the inclusion of any part imported from another
7
8 state other than a generic and insignificant part as defined in this
8
9 section.

10 C. For purposes of this section, a firearm suppressor is
10
11 manufactured in this state if it is manufactured without regard to
11
12 whether a firearm imported into this state from another state is
12
13 attached to or used in conjunction with the suppressor.

14 D. No agency, municipality, or other political subdivision
14
15 shall adopt a rule, order, ordinance, or policy under which the
15
16 entity enforces an order, rule, or regulation that purports to
16
17 regulate a firearm suppressor if the statute, order, rule, or
17
18 regulation imposes a prohibition, restriction, or other regulation
18
19 that does not exist under the laws of this state.

20 E. As used in this section:

21 1. “Firearm” shall have the same definition as provided in
21
22 Section 1289.3 of Title 21 of the Oklahoma Statutes;
22
23 2. “Firearm suppressor” means any device designed, made, or
23
24 adapted to muffle the report of a firearm;

1 3. “Generic and insignificant part” means an item that has

2 manufacturing or consumer product applications other than inclusion
2
3 in a firearm suppressor. The term includes but is not limited to a
3
4 spring, screw, nut, or pin; and
4
5 4. “Manufacture” includes forging, casting, machining, or
5
6 another process for working a material.

7 SECTION 2. This act shall become effective November 1, 2024.
