7 An Act relating to unlawful contracts; amending 15
7 O.S. 2021, Section 219A, which relates to
8 noncompetition agreements; clarifying certain
8 contractual provisions; and providing an effective
9 date.

12 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

13 SECTION 1. AMENDATORY 15 O.S. 2021, Section 219A, is
13
14 amended to read as follows:
14
15 Section 219A. A. A person who makes an agreement with an
15
16 employer, whether in writing or verbally, not to compete with the
16
17 employer after the employment relationship has been terminated,
17
18 shall be permitted to engage in the same business as that conducted
18
19 by the former employer or in a similar business as that conducted by
19
20 the former employer as long as the former employee does not directly
20
21 solicit, directly or indirectly, actively or inactively, the sale of
21
22 goods, services or a combination of goods and services from the
22
23 established customers or independent contractors of the former
23
24 employer.

 1 B. Any provision in a contract between an employer and an

2 employee in conflict with the provisions of this section shall be
2
3 void and unenforceable.

4 SECTION 2. This act shall become effective November 1, 2024.
