7 An Act relating to noneconomic damages; amending 23
7 O.S. 2021, Section 61, which relates to obligation
8 not arising from contract; prohibiting party from
8 referencing noneconomic damages to jury in certain
9 actions; and providing an effective date.

12 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

13 SECTION 1. AMENDATORY 23 O.S. 2021, Section 61, is
13
14 amended to read as follows:

15 Section 61. A. For the breach of an obligation not arising
15
16 from contract, the measure of damages, except where otherwise
16
17 expressly provided by this chapter, is the amount which will
17
18 compensate for all detriment proximately caused thereby, whether it
18
19 could have been anticipated or not.

20 B. In a trial in an action for the breach of an obligation not
20
21 arising from contract, a party or counsel for a party shall not seek
21
22 or refer to a specific dollar amount, state a range, or suggest a
22
23 mathematical formula for the jury to consider with respect to an
23
24 award for noneconomic damages.

 1 SECTION 2. This act shall become effective November 1, 2024.
