7 An Act relating to the Opioid Overdose Fatality
7 Review Board; amending 63 O.S. 2021, Section 2-1002,
8 which relates to composition and meetings of the
8 Board; modifying required frequency of meetings;
9 establishing quorum and certain voting threshold;
9 updating statutory reference; updating statutory
10 language; providing an effective date; and declaring
10 an emergency.

14 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

15 SECTION 1. AMENDATORY 63 O.S. 2021, Section 2-1002, is
15
16 amended to read as follows:
16
17 Section 2-1002. A. The Opioid Overdose Fatality Review Board
17
18 shall be composed of twenty-two (22) members, or their designees, as
18
19 follows:
19
20 1. Twelve of the members shall be:
20
21 a. the Attorney General or designee,
21
22 b. the Chief Medical Examiner or designee,
22
23 c. the State Commissioner of Health or designee,

1 d. the Chief of Injury Prevention Services of the State

2 Department of Health or designee,
2
3 e. the President of the Oklahoma State Medical
3
4 Association or designee,
4
5 f. the Director of the Oklahoma State Bureau of Narcotics
5
6 and Dangerous Drugs Control or designee,
6
7 g. the Commissioner of the Department of Mental Health
7
8 and Substance Abuse Services or designee,
8
9 h. the President of the Oklahoma Osteopathic Association
9
10 or designee,
10
11 i. the Director of the Department of Human Services or
11
12 designee,
12
13 j. the Director of the Oklahoma State Bureau of
13
14 Investigation or designee,
14
15 k. the President of the Association of Oklahoma Narcotic
15
16 Enforcers or designee, and
16
17 l. the Executive Director of the State Board of Pharmacy
17
18 or designee; and
18
19 2. Ten of the members shall be appointed by the Attorney
19
20 General, shall serve for terms of two (2) years and shall be
20
21 eligible for reappointment. The members shall be persons having
21
22 training and experience in matters related to opioid abuse and
22
23 prevention. The appointed members shall include:

1 a. a county sheriff selected from a list of three names
1
2 submitted by the executive board of the Oklahoma
2
3 Sheriffs’ Association,
3
4 b. a chief of a municipal police department selected from
4
5 a list of three names submitted by the Oklahoma
5
6 Association of Chiefs of Police,
6
7 c. an attorney licensed in this state who is in private
7
8 practice selected from a list of three names submitted
8
9 by the Board of Governors of the Oklahoma Bar
9
10 Association,
10
11 d. a district attorney selected from a list of three
11
12 names submitted by the District Attorneys Council,
12
13 e. a physician with emergency medical training selected
13
14 from a list of three names submitted by the Oklahoma
14
15 State Medical Association,
15
16 f. a physician with experience in drug addiction
16
17 treatment and recovery selected from a list of three
17
18 names submitted by the Oklahoma Osteopathic
18
19 Association,
19
20 g. a nurse selected from a list of three names submitted
20
21 by the Oklahoma Nurses Association,
21
22 h. two individuals, at least one of whom shall be a
22
23 person who currently receives or formerly has been a
23
24 consumer of addiction recovery services related to

1 opioid use, selected from a list of three names
1
2 submitted by the Department of Mental Health and
2
3 Substance Abuse Services, and
3
4 i. a member of the judiciary selected from a list of
4
5 three names submitted by the Oklahoma Supreme Court.

6 B. Every two (2) years the Board shall elect from among its
6
7 membership a chair and a vice-chair vice chair. The Board shall
7
8 meet at least quarterly and may meet more as frequently as necessary
8
9 as determined by the chair. Nine members shall constitute a quorum,
9
10 and a majority of the required quorum shall be sufficient for the
10
11 Board to take action by vote. Members shall serve without
11
12 compensation but may be reimbursed for necessary travel out of funds
12
13 available to the Office of the Attorney General and the Department
13
14 of Mental Health and Substance Abuse Services pursuant to the State
14
15 Travel Reimbursement Act; provided, that the reimbursement shall be
15
16 paid in the case of state employee members by the agency employing
16
17 the member.

18 C. With funds appropriated or otherwise available for that
18
19 purpose, the Office of the Attorney General, jointly with the
19
20 Department of Mental Health and Substance Abuse Services, shall
20
21 provide administrative assistance and services to the Opioid
21
22 Overdose Fatality Review Board.

23 SECTION 2. This act shall become effective July 1, 2024.

1 SECTION 3. It being immediately necessary for the preservation
1
2 of the public peace, health or safety, an emergency is hereby
2
3 declared to exist, by reason whereof this act shall take effect and
3
4 be in full force from and after its passage and approval.
