6 An Act relating to the Department of Environmental
Quality; creating the Blue River-Little Blue Creek
7 Stream Health Assessment Study Revolving Fund;
establishing fund source and purpose; establishing
8 Blue River-Little Blue Creek Stream Health Assessment
Study; requiring coordination with certain entity for
9 certain purposes; providing for coordination with
certain state and federal agencies; providing for
10 codification; providing an effective date; and
declaring an emergency.

13 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
14 SECTION 1. NEW LAW A new section of law to be codified
15 in the Oklahoma Statutes as Section 2-3-404 of Title 27A, unless
16 there is created a duplication in numbering, reads as follows:
17 A. There is hereby created in the State Treasury a revolving
18 fund for the Department of Environmental Quality to be designated
19 the “Blue River-Little Blue Creek Stream Health Assessment Study
20 Revolving Fund”. The fund shall be a continuing fund, not subject
21 to fiscal year limitations, and shall consist of all monies received
22 by the Department from appropriations, apportionments, donations,
23 and federal grants received for the purpose of completing the study
24 created pursuant to subsection B of this section. All monies

1 accruing to the credit of the fund are hereby appropriated and may
2 be budgeted and expended by the Department for the purpose provided
3 for in this section. Expenditures from the fund shall be made upon
4 warrants issued by the State Treasurer against claims filed as
5 prescribed by law with the Director of the Office of Management and
6 Enterprise Services for approval and payment.
7 B. Pursuant to the requirements of Section 1-3-101 of Title 27A
8 of the Oklahoma Statutes as it relates to waters emanating from a
9 sensitive sole source aquifer, the Department shall establish and
10 perform a Blue River-Little Blue Creek Stream Health Assessment
11 Study. The Department shall coordinate with the Center for
12 Reservoir and Aquatic Systems Research at Baylor University for the
13 purpose of defining the study scope and conducting the work
14 necessary to complete data collection and the development of the
15 Blue River-Little Blue Creek Stream Health Assessment Study. The
16 Department may coordinate with other relevant state and federal
17 agencies to effectuate the provisions of this section.
18 SECTION 2. This act shall become effective July 1, 2024.
19 SECTION 3. It being immediately necessary for the preservation
20 of the public peace, health or safety, an emergency is hereby
21 declared to exist, by reason whereof this act shall take effect and
22 be in full force from and after its passage and approval.
