7 An Act relating to the Oklahoma Water Resources
7 Board; creating the Arkansas River Levee Improvement
8 Revolving Fund; making an appropriation; stating
8 source of funds; allowing certain deposits; stating
9 purpose; providing for codification; providing an
9 effective date; and declaring an emergency.

12 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

13 SECTION 1. NEW LAW A new section of law to be codified
13
14 in the Oklahoma Statutes as Section 1085.7D of Title 82, unless
14
15 there is created a duplication in numbering, reads as follows:
15
16 A. There is hereby created in the State Treasury a revolving
16
17 fund for the Oklahoma Water Resources Board to be designated the
17
18 “Arkansas River Levee Improvement Revolving Fund”. The fund shall
18
19 be a continuing fund, not subject to fiscal year limitations, and
19
20 shall consist of all monies received by the Oklahoma Water Resources
20
21 Board from legislative appropriations provided for the purpose of
21
22 providing levee improvements and matching funds for levee projects
22
23 along the Arkansas River. All monies accruing to the credit of the
23
24 fund are hereby appropriated and may be budgeted and expended by the

1 Oklahoma Water Resources Board for the purpose provided for in this

2 section. Expenditures from the fund shall be made upon warrants
2
3 issued by the State Treasurer against claims filed as prescribed by
3
4 law with the Director of the Office of Management and Enterprise
4
5 Services for approval and payment.

6 B. Notwithstanding any other provision of law, income and
6
7 earnings on the fund shall accrue to the fund and may be used for
7
8 the purposes provided for in this section.

9 SECTION 2. There is hereby appropriated to the Oklahoma Water
9
10 Resources Board for deposit to the Arkansas River Levee Improvement
10
11 Revolving Fund from any monies not otherwise appropriated from the
11
12 General Revenue Fund of the State Treasury for the fiscal year
12
13 ending June 30, 2025, the sum of Sixty-seven Million Dollars
13
14 ($67,000,000.00) or so much thereof as may be necessary to fund the
14
15 Arkansas River Levee Improvement Revolving Fund.
15
16 SECTION 3. This act shall become effective July 1, 2024.
16
17 SECTION 4. It being immediately necessary for the preservation
17
18 of the public peace, health or safety, an emergency is hereby
18
19 declared to exist, by reason whereof this act shall take effect and
19
20 be in full force from and after its passage and approval.
