7 General; creating the Federal Overreach and
8 Extraordinary Litigation Revolving Fund; specifying
8 source of fund; providing for expenditures; providing
9 purpose of fund; providing for codification;
9 providing an effective date; and declaring an
10 emergency.

13 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

14 SECTION 1. NEW LAW A new section of law to be codified
14
15 in the Oklahoma Statutes as Section 30.9 of Title 74, unless there
15
16 is created a duplication in numbering, reads as follows:

17 There is hereby created in the State Treasury a revolving fund
17
18 for the Office of the Attorney General to be designated the “Federal
18
19 Overreach and Extraordinary Litigation Revolving Fund”. This fund
19
20 shall be a continuing fund, not subject to fiscal year limitations,
20
21 and shall consist of all monies received by the Office of the
21
22 Attorney General from legislative appropriations provided for the
22
23 purpose of representing the State of Oklahoma in cases of fighting
23
24 federal overreach in Oklahoma, pursuant to Enrolled House Bill No.

 1 1236 of the 1st Session of the 58th Oklahoma Legislature,

2 extraordinary litigation costs, foreign threats, interstate crime,
2
3 terrorist organizations, gross violations of public trust, and
3
4 statewide public safety. All monies accruing to the credit of the
4
5 fund are hereby appropriated and may be budgeted and expended by the
5
6 Office of the Attorney General for the purpose provided by this
6
7 section. Expenditures from the fund shall be made upon warrants
7
8 issued by the State Treasurer against claims filed as prescribed by
8
9 law with the Director of the Office of Management and Enterprise
9
10 Services for approval and payment.

11 SECTION 2. This act shall become effective July 1, 2024.
11
12 SECTION 3. It being immediately necessary for the preservation
12
13 of the public peace, health or safety, an emergency is hereby
13
14 declared to exist, by reason whereof this act shall take effect and
14
15 be in full force from and after its passage and approval.
