7 An Act relating to cosmetology and barbering;
7 amending 59 O.S. 2021, Section 199.2, which relates
8 to the State Board of Cosmetology and Barbering;
8 extending sunset; transferring all duties and
9 responsibilities of the Board to the State Department
9 of Health on certain date; and providing an effective
10 date.

13 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

14 SECTION 1. AMENDATORY 59 O.S. 2021, Section 199.2, is
14
15 amended to read as follows:
15
16 Section 199.2. A. 1. There is hereby re-created, to continue
16
17 until July 1, 2024 2025, in accordance with the provisions of the
17
18 Oklahoma Sunset Law, a State Board of Cosmetology and Barbering
18
19 which shall be composed of eleven (11) members to be appointed by
19
20 the Governor and to serve at the pleasure of the Governor. On July
20
21 1, 2025, the State Board of Cosmetology and Barbering and all duties
21
22 and responsibilities associated with the Oklahoma Cosmetology and
22
23 Barbering Act shall be transferred to the State Department of
23
24 Health.

1 2. One member shall be appointed from each congressional

2 district and the additional members shall be appointed at-large.
2
3 However, when congressional districts are redrawn, each member
3
4 appointed prior to July 1 of the year in which such modification
4
5 becomes effective shall complete the current term of office and
5
6 appointments made after July 1 of the year in which such
6
7 modification becomes effective shall be based on the redrawn
7
8 districts. Appointments made after July 1 of the year in which such
8
9 modification becomes effective shall be from any redrawn districts
9
10 which are not represented by a board member until such time as each
10
11 of the modified congressional districts are represented by a board
11
12 member. One member shall be a barber appointed at-large.
12
13 3. At the time of appointment, the members shall be citizens of
13
14 this state, at least twenty-five (25) years of age, and shall be
14
15 high school graduates. Six members shall, at the time of
15
16 appointment, have had at least five (5) years’ continuous practical
16
17 experience in the practice of cosmetology in this state; one member
17
18 shall be appointed at large and, at the time of the appointment,
18
19 have had at least five (5) years’ continuous practical experience in
19
20 the practice of barbering in this state; one member shall be a lay
20
21 person; one member shall be an administrator of a licensed private
21
22 cosmetology school; one member shall be an administrator of a
22
23 licensed barber school; and one member shall be an administrator of
23
24 a public school licensed to teach cosmetology or barbering.

1 4. No two members shall be graduates of the same cosmetology

2 school, nor shall they be organizers of or promote the organization
2
3 of any cosmetic, beauty, or hairdressers’ association. Each of the
3
4 eight cosmetology appointees shall continue to be actively engaged
4
5 in the profession of cosmetology while serving. No two members
5
6 engaged in the profession of barbering shall be organizers of or
6
7 promote the organization of any barbering association. Each of the
7
8 two barbering appointees shall continue to be actively engaged in
8
9 the profession of barbering while serving.

10 5. If any member retires or ceases to practice his or her
10
11 profession during the term of membership on the Board, such terms
11
12 shall automatically cease and the Governor shall appoint a like-
12
13 qualified person to fulfill the remainder of the term.
13
14 B. The terms of office for Board members shall be four (4)
14
15 years ending June 30.

16 C. Each member shall serve until a successor is appointed and
16
17 qualified.

18 D. Six members of the Board shall constitute a quorum for the
18
19 transaction of business.
19
20 E. The Governor may remove any member of the Board at any time
20
21 at the Governor’s discretion. Vacancies shall be filled by
21
22 appointment by the Governor for the unexpired portion of the term.
22
23 F. The Board shall organize by electing from its membership a
23
24 chair and vice-chair, each to serve for a period of one (1) year.

1 The presiding officer shall not be entitled to vote upon any
1
2 question except in the case of a tie vote.

3 Members shall be reimbursed for their actual and necessary
3
4 traveling expenses as provided by the State Travel Reimbursement
4
5 Act.
5
6 G. Within thirty (30) days after the end of each fiscal year,
6
7 the Board shall make a full report to the Governor of all its
7
8 receipts and expenditures, and also a full statement of its work
8
9 during the year, together with such recommendations as the Board
9
10 deems expedient.

11 H. The Board may expend funds for suitable office space for the
11
12 transaction of its business. The Board shall adopt a common seal
12
13 for the use of the executive director in authenticating Board
13
14 documents.
14
15 I. The Board shall meet at its office for the transaction of
15
16 such business as may come before it on the second Monday in January,
16
17 March, May, July, September, and November and at such other times as
17
18 it may deem advisable.

19 SECTION 2. This act shall become effective November 1, 2024.
