8 A Joint Resolution directing the Secretary of State
to refer to the people for their approval or
9 rejection a proposed amendment to Section 26 of
Article II of the Constitution of the State of
10 Oklahoma; expanding rights of citizens to keep and
bear arms; updating language; providing ballot title;
11 and directing filing.

14 BE IT RESOLVED BY THE HOUSE OF REPRESENTATIVES AND THE SENATE OF THE
15 1ST SESSION OF THE 59TH OKLAHOMA LEGISLATURE:
16 SECTION 1. The Secretary of State shall refer to the people for
17 their approval or rejection, as and in the manner provided by law,
18 the following proposed amendment to Section 26 of Article II of the
19 Constitution of the State of Oklahoma to read as follows:
20 Section 26. A. The fundamental right of a each individual
21 citizen to keep and to bear arms in defense of his home, or her
22 person, or property, or including handguns, rifles, shotguns,
23 knives, nonlethal defensive weapons, and other arms in common use,
24 as well as ammunition and the components of arms and ammunition, for

1 self-defense, lawful hunting and recreation, in aid of the civil
2 power, when thereunto legally lawfully summoned, or for any other
3 legitimate purpose, shall never be prohibited; but nothing herein
4 contained not be infringed.
5 B. This section shall not prevent the Legislature from
6 regulating the carrying of weapons enforcing or adopting narrowly
7 tailored time, place, and manner regulations, or authorizing
8 political subdivisions to adopt and enforce such regulations, to
9 serve a compelling state interest.
10 C. No law shall impose registration or special taxation upon
11 the keeping of arms including the acquisition, ownership,
12 possession, or transfer of arms, ammunition, or the components of
13 arms or ammunition.
14 SECTION 2. The Ballot Title for the proposed Constitutional
15 amendment as set forth in SECTION 1 of this resolution shall be in
16 the following form:

19 THE GIST OF THE PROPOSITION IS AS FOLLOWS:
20 This measure would amend Section 26 of Article 2 of the Oklahoma
21 Constitution. This measure would prevent infringement of the
22 fundamental right of a citizen to keep and to bear arms. This
23 measure will not prevent the Legislature from adopting
24 regulations that serve a narrowly tailored compelling state

1 interest. This measure would prohibit the imposition of
2 registration or special taxation upon the keeping of or the
3 transfer of arms, ammunition, or the components of arms or
4 ammunition.

8 SECTION 3. The Chief Clerk of the House of Representatives,
9 immediately after the passage of this resolution, shall prepare and
10 file one copy thereof, including the Ballot Title set forth in
11 SECTION 2 hereof, with the Secretary of State and one copy with the
12 Attorney General.
