7 An Act relating to the Oklahoma Department of
Agriculture, Food, and Forestry; empowering certain
8 regulation of certain disease related to cervidae;
prohibiting certain regulation; authorizing the
9 promulgation of rules; requiring certain
consultation; providing for codification; and
10 providing an effective date.

13 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
14 SECTION 1. NEW LAW A new section of law to be codified
15 in the Oklahoma Statutes as Section 2.4F of Title 2, unless there is
16 created a duplication in numbering, reads as follows:
17 A. Except as may otherwise be provided by law, the Oklahoma
18 Department of Agriculture, Food, and Forestry shall be the state
19 entity empowered to implement all policy of the state regarding the
20 care, testing, and regulation of Chronic Wasting Disease and its
21 presence or lack thereof among cervidae in the state.
22 B. The Department shall, in consultation with no less than two
23 (2) out-of-state individuals or researchers reasonably considered by
24 the Department to be experts in the field of animal diseases,

1 promulgate rules as needed to implement the provisions of this act.
2 No municipality, county, or other state agency or political
3 subdivision of this state shall enact or enforce any order,
4 ordinance, or regulation, or perform actions which conflict with,
5 duplicate, or impede the authority provided to the Oklahoma
6 Department of Agriculture, Food, and Forestry pursuant to Section A
7 of this act.
8 SECTION 2. This act shall become effective November 1, 2023.
