7 An Act relating to mental health; amending 43A O.S.
2021, Section 10-111.1, which relates to vulnerable
8 adult abuse, neglect and exploitation; providing that
the Office of the Attorney General maintain a
9 registry; providing that certain information be made
available to the public; providing information that
10 shall be included in the registry; and providing an
effective date.

15 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
16 SECTION 1. AMENDATORY 43A O.S. 2021, Section 10-111.1,
17 is amended to read as follows:
18 Section 10-111.1 A. On or before January 1, 2019 2024, the
19 Office of the Attorney General shall promulgate rules to establish
20 and maintain the Vulnerable Adult Abuse, Neglect and Exploitation
21 Report Registry, accessible to the public on the Internet in an
22 electronic format that is easily, and readily searchable. updated
23 quarterly, to address:

1 1. A procedure for recording individuals on the registry who
2 have been found guilty by a court of law or entered a plea of nolo
3 contendere to a charge of abuse, neglect or exploitation of a
4 vulnerable adult; and
5 2. Disclosure requirements for information that is accessible
6 on the registry.
7 B. The Vulnerable Adult Abuse, Neglect and Exploitation
8 Registry shall include, but not be limited to:
9 1. The full name of the individual;
10 2. Information necessary to identify the individual;
11 3. A description of the findings of abuse, neglect or
12 exploitation by a court of law; and
13 4. The date the individual was listed on the registry
14 B. The report created in subsection A of this section shall be
15 maintained by the Office of the Attorney General and shall include a
16 list of defendants who have been prosecuted by the Office of the
17 Attorney General and have been found guilty by a court of law for
18 abuse, exploitation or neglect of elderly or vulnerable adults in
19 the preceding twelve (12) months. The report shall be provided to
20 the Governor, the Speaker of the House of Representatives and the
21 President Pro Tempore of the Senate on an annual basis beginning
22 January 31, 2019. The report shall include, but not be limited to:
23 1. The name of the defendant;
24 2. The crime for which the defendant was convicted;

1 3. A description of the findings of abuse, neglect or
2 exploitation by the Office of the Attorney General, including the
3 circumstances surrounding the abuse;
4 4. The date of conviction or the date that a plea of guilty or
5 nolo contendere was accepted by the court;
6 5. The relationship of the defendant to the victim; and
7 6. The county where the offense or offenses occurred.
8 SECTION 2. This act shall become effective November 1, 2023.
