7 An Act relating to Alzheimer's and dementia disease;
repealing 63 O.S. 2021, Sections 1-879.2, and 1-
8 879.3, which relate to Alzheimer's Research Advisory
Council and Duties and Development and Enhancement of
9 Core Neuropathy Laboratory; creating the Alzheimer's
Disease and Related Dementia Infrastructure Act;
10 defining terms; creating the Office of Alzheimer's
Disease and Related Dementia Resource Coordination;
11 creating rules; creating a fund; creating a committee
for awards; providing for codification; and providing
12 an effective date.

15 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
16 SECTION 1. REPEALER 63 O.S. 2021, Sections 1-879.2, and
17 1-879.3, are hereby repealed.
18 SECTION 2. NEW LAW A new section of law to be codified
19 in the Oklahoma Statutes as Section 1-879.5 of Title 63, unless
20 there is created a duplication in numbering, reads as follows:
21 This act shall be known and may be cited as the "Alzheimer's
22 Disease and Related Dementia Infrastructure Act".

1 SECTION 3. NEW LAW A new section of law to be codified
2 in the Oklahoma Statutes as Section 1-879.6 of Title 63, unless
3 there is created a duplication in numbering, reads as follows:
4 The purpose of this act is to develop a coordinated state
5 structure and state and community response to dementia that meets
6 the growing need for dementia-specific services, research and
7 community education, and caregiver support.
8 SECTION 4. NEW LAW A new section of law to be codified
9 in the Oklahoma Statutes as Section 1-879.7 of Title 63, unless
10 there is created a duplication in numbering, reads as follows:
11 As used in this act:
12 1. "Alzheimer's and Related Dementia State Plan" means a plan
13 developed by the state in conjunction with stakeholders for meeting
14 the needs of individuals with Alzheimer's disease and related
15 dementia or diagnosis and their caregivers;
16 2. "Caregiver" means any person other than a paid provider who
17 provides care for a person with dementia; and
18 3. "Dementia" means a degenerative disease of the central
19 nervous system characterized especially by premature cognitive
20 deterioration. This includes Alzheimer's disease and related
21 dementia and diagnoses which are similarly marked by irreversible
22 deterioration of intellectual faculties with concomitant emotional
23 disturbance resulting from organic brain disorder, such as:
24 a. Chronic Traumatic Encephalopathy,

1 b. Creutzfeldt-Jakob Syndrome,
2 c. Frontotemporal dementias,
3 d. Huntington's disease,
4 e. Korsakoff's Syndrome,
5 f. Lewy-body disease,
6 g. Parkinson's disease,
7 h. Progressive supranuclear palsy,
8 i. Vascular dementia, or
9 j. any other neurocognitive brain disorder that results
10 in the irreversible deterioration of intellectual
11 faculties.
12 SECTION 5. NEW LAW A new section of law to be codified
13 in the Oklahoma Statutes as Section 1-879.8 of Title 63, unless
14 there is created a duplication in numbering, reads as follows:
15 A. In the State Department of Health, there is hereby created
16 an Office of Alzheimer's Disease and Related Dementia Resource
17 Coordination to provide statewide coordination, service system
18 development, and information on education, support, and other
19 available services. The Office shall provide the following:
20 1. Initiate the development of systems which coordinate the
21 delivery of programs and services;
22 2. Facilitate the coordination and integration of research,
23 program development, planning, and quality assurance;

1 3. Identify potential users of services and gaps in the service
2 delivery system and expand methods and resources to enhance
3 statewide services;
4 4. Serve as a resource for education, research, and training
5 and provide information on available services;
6 5. Provide technical assistance for the application of relevant
7 federal and state grants;
8 6. Provide technical assistance for state and local initiatives
9 to serve individuals, families, and caregivers;
10 7. Work with relevant State Department of Health staff to
11 recommend public policy concerning Alzheimer's disease and related
12 dementia to state policymakers;
13 8. Facilitate the coordination of Alzheimer's State Plan re-
14 write every four (4) years, stakeholder involvement in the re-write,
15 amendments to the Alzheimer's State Plan during the re-write interim
16 period, and any progress reports, updates, and other communication
17 regarding the Alzheimer's State Plan;
18 9. Submit an annual report that details Alzheimer's State Plan
19 implementation progress, information on service delivery system
20 developments and gaps, research updates, and resources, outreach,
21 and information to The Advancement of Wellness Advisory Council as
22 defined in Section 1-103a.1 of Title 63 of the Oklahoma Statutes,
23 for review and approval. Upon approval the annual report shall be
24 provided to the Secretary of Health and Human Services, the Office

1 of the Governor, the Oklahoma State Legislature, and made publicly
2 available on the State Department of Health's website; and
3 10. Facilitate the coordination and integration of educational
4 initiatives for health care providers on the importance and value of
5 early detection and timely diagnosis of cognitive impairment,
6 validated cognitive assessment tools, and increasing understanding
7 and awareness of early warning signs of Alzheimer's disease and
8 other types of dementia and how to reduce the risk of cognitive
9 decline.
10 B. The Office of Alzheimer's Disease and Related Dementia
11 Resource Coordination shall maintain on staff at least one (1)
12 dementia services manager. The dementia services manager shall be a
13 full-time, permanent employee and shall be responsible for the
14 staffing and operational details of the Office of Alzheimer's
15 Disease and Related Dementia Resource Coordination.
16 SECTION 6. NEW LAW A new section of law to be codified
17 in the Oklahoma Statutes as Section 1-879.9 of Title 63, unless
18 there is created a duplication in numbering, reads as follows:
19 There is hereby established a fund known as the Alzheimer's
20 Disease and Related Dementia Research Fund, hereafter referred to as
21 "the Research Fund". The Research Fund shall be administered by the
22 State Department of Health's Office of Alzheimer's Disease and
23 Related Dementia Resource Coordination.

1 A. The awards shall be made through an awards committee of
2 seven (7) members, coordinated by the dementia services manager
3 consisting of three (3) representatives from the scientific and
4 medical communities, three (3) members of the general public, and
5 the dementia services manager.
6 B. The awards shall be given annually to selected applicants
7 residing and performing research in the state of Oklahoma in order
8 to support research into the causes of Alzheimer's disease and
9 related disorders, methods of treatment, ways that families can cope
10 with the stresses of the disease, and the impact of the disease on
11 Oklahoma.
12 C. Information on the awardee, project, and dollars awarded
13 shall be included in the annual report as defined in paragraph 9 of
14 Section 5 of this act.
15 SECTION 7. NEW LAW A new section of law to be codified
16 in the Oklahoma Statutes as Section 1-879.10 of Title 63, unless
17 there is created a duplication in numbering, reads as follows:
18 A. There is hereby established a fund known as the Dementia
19 Caregiver Support Group and Education Program Development Fund,
20 hereafter referred to as the "Dementia Support and Education
21 Development Fund".
22 B. The Dementia Support and Education Development Fund shall be
23 administered by the State Department of Health's Office of
24 Alzheimer's Disease and Related Dementia Resource Coordination. The

1 awards shall be made through an awards committee of five (5)
2 members, facilitated by the dementia services manager consisting of
3 representatives from the Alzheimer's Disease and Related Dementia
4 State Plan writing committee.
5 C. The awards shall be given annually to non-profit applicants
6 residing in the state of Oklahoma in areas of the state meeting the
7 Census Bureau classification of rural in order to support community
8 efforts to establish Alzheimer's disease and related dementia
9 caregiver support group and evidence-based community education
10 programs.
11 D. The Office of Alzheimer's Disease and Related Dementia
12 Resource Coordination shall include information on the awardee(s),
13 project(s), and dollars awarded in the annual report as defined in
14 paragraph 9 of Section 5 of this act.
15 E. The fund shall sunset five (5) years from the enactment of
16 this language.
17 SECTION 8. This act shall become effective November 1, 2023.
